Enclosed is a copy of the agreement that was approved by both parties. On May 11, 1998, I received a letter from Mike Sharp, Superintendent with Dallas County Road and Bridge District//1, showing th e cost for the referenced project. of the access and parking areas. This letter is written to request that Coppell Independent School District provide the City of Coppell with a check in the amount of $24,414.50 for payment of your share of the paving of the access and parking areas. Box 478 Coppell, Texas 75019 Re: Project IJ426 - Coppell Middle School Parking Lots Dear Mr. Martin: The referenced project has been completed for a total cost of $52,698.59, which includes materials, equipment and labor, as shown on the attached breakdown. The attachment also indicates the portion of the total expenses which are the responsibility of the School District. The City escmwed $49,338.58 for materials and equipment. The total expenses for those two items are $43,692.44. This figure does not reflect 756 cubic yards of RAp (recycled asphalt pavement) used on the bus parking lot and 198 cubic yards of RAp used on the City parking lot. These materials, valued at $4,140.36 ($4.34 per cubic yard), were obtained without charge from the Texas Department of Transportation. The escrow balance of $5,646.14 is being processed for return to the City and should be available shortly. If you have any questions in this regard, please feel flee to contact me. Michael L. W'ffEREAS, the City of Coppert, Texas, a home rule municipality, hereinafier called "City" and the Coppell Independent School District, hereinafier called "CISD" desire to enter into an agreement whereby the CISD will reimburse the City for CISD's share of the costs of paving the Coppert Middle School West parking lot and roadway facilities on Wrangler Road as a i'esult of an Interlocal Cooperation Agreement entered into between the City of Coppell and Dallas County for such repairs, set forth in Exhibit "A". WI~.REAS, Chapter 791 of the Texas Government Code, as amended, provides authorization for local governments to enter into interlocal contracts; and WHEREAS, the City has entered into an agreement with Dallas County to lease equipment and obtain necessary materials from the County to reconstruct and pave the West parking lot at the Coppell Middle School and the roadway facilities on Wrangler Road in the City C'Paving Project"). The City has agreed to directly pay Dallas County $62,787.45 for the equipment, materials, and labor needed for the project; and WI~'EREAS, th~s interlocal contract has been authorized by the governing bodies of both the City and CISD; and W~rEREAS, the payments for the performance of governmental functions and/or services set out herein will be made fi'om current revenues available to the City and CISD. NOW, Tm~.REFORE, in consideration of ten ($I0.00) dollars and other valuable consideration, the receipt and sufficiency of which are hereby acknowledged the City and CISD agree as follows: WITNESSETH: L CISD a~rces to reimburse the City for its share of the cost to pave the Coppell Middle School West parking lot and the roadway facilities on Wrangler Road which includes CISD bus parIcing lot and Phase I of the City/County Agreement. In the event, that CISD's actual share of the cost exceeds the sum of $31,000.00, then CISD shall not be bound to pay the amount exceeding $31,000,00 unless written amendmeni providing for such payment is executed by CISD. Consistent with this paragraph, CISD ag~..ees to pay its share of the aforesaid costs to the City within thirty (30) days after written notification from the City of the CISD's final share of the cost of the Paving Project. This Agreement shall be binding upon and inure to the benefit of the parties herato end their respective successors and assigns. No amendment, modification or alteration of the terms hereof shall be bindhg unless the same be in writing, dated subsequent to the date of this Agreement and duly executed by the parties. The obligations and undertakings of esch of the parties of this Agreement are and shall be performed in Dallas County, Texas. The validity of the Agreement and any of its terms or provisions, as well as the rights and duties of the parties, shall be governed by the law of the State of Texas; and any venue for any action concerning this Agreement shall be in Dallas County, Texas. All parties represent that they have full capacity and authority to grant all rights and assume all obligations that they have granted and assumed in this Agreement. VI.
