CITY/COUNTY AGREEMENr
WHEREAS, the City of Coppell, Texas, heroinafter called "City," and tile County of Dallas, Texas,
hereina~er called "County," desire to enter into an agreement whereby the City will lease the equipment and
obtain ~c n~ces~ry materials from the County to reconstruct two parking lots in the City, one at West Park
at Coppell Middle School and one on Wrangler Road ut;d for school bus parking. as outlin~:l in Attaciunents
"A" and "B." The equipment will be operated by County employees on non-County-working days, with
payment for labor, estimated at $13,448.87, to be made directly to tile personnel involved. The total
estimated cost of this work, including labor, is $62,787.45. The City will place the remaining $49338.58
in escrow with the County to provide for 100% reimbursement of equipment leasing and materials costs; and
WHEREAS, C:haptcr 791 of the Texas Government Code, as amended, provides authorization for
local governments Io cntcr into interlocal contracts.
NOW, THEREFORE, TI IIS MEMORANDUM OF AGREEMENT is hereby made and entered into
by thc City and the County upon and for the mutual consideration stated heroin.
WITNESSETI I:
City requests County to lease to City the necessary equipment 1o rccunslruct two parking lots in the
City, as indicated above, with labor costs I~ bc paid directly tn County employees working during non-
County-working time and with remaining costs of $49,338.58 for equipment leasing and materials to b¢
reimbursed to the Count~'. The City will place the amounl of $49,338.58 in escrow with the County tbr that
purpose.
II.
City will b~ responsible for drainage and will insure that proposed work on parking lots will not have
an adverse effect on the surronnding property, City will remove the work shed from the bus parking lot and
will clear the lot of buses. City will bc responsible for removal of the security fence and its replacement after
completion of the work,
III.
The City agrees to indemnify and save harmless the County from any liability or dama~J,;s the
Count)' may suffel as a result of claims, denlands, costs or judgments against the County arising out of the
services under this agreement or arising from an)' accident, injury or damage whatsoever to any person or
persons, or to the prc~perty of any person(s) or corporation(s) occurring during tile leasing of equipment on
this project.
