Stoheleigh at Riverchase reimbursement cheek for Roadway Impact Fees
On September 30, 1997 the City received $23,835.38 for Roadway Impact Fees associated with
the Stoneleigh at Riverchase development. That amount was based on an 89.02% credit given
for the developers prior construction of Riverehase Drive from Sandy Lake Road to MaeArthur
Blvd. However, on December 29, 1997 the City entered into a developers agreement with RPG
Estates, Ltd. concerning the construction of Fairway Drive. Section 3 of that agreement states
that the City will give 100% credit to the owner against Roadway Impact Fees associate with the
Stoneleigh at Riverchase development and the adjacent 20 acres of multi-family zoned property.
When the City assessed the Impact Fees, we overlooked the 1997 developers agreement and
assessed approximately 11% of the Impact Fees due. This was an error on my part. To rectify
the error Jerry Ragsdale has requested that we reimburse the $23,835.38 that was placed in Zone
7. The reimbursement cheek should be made out to American Title Company. Once the check
has been processed it can be mailed to Mr. Bo Feagin, American Title Company, 3131 Turtle
Creek Blvd., Suite 202, Dallas, Texas 75219.
Attached are copies of the developers agreement, cash receipt, Roadway Impact Fee deposits,

As a follow-up to our telephone conversation, enclosed is a copy of the
agreement concerning the construction of Fairway Drive. Paragraph 3 of the
agreement provides for a credit in an amount equal to 100% of the roadway impact
fees.
Also enclosed is a copy of the development fee assessment schedule for
Stoneleigh at Riverchase. Included was an amount of $23,835.38 for roadway impact
fees. Pursuant to the Fairway Drive Agreement we are hereby requesting a refund in
the amount of $23,835.38. Please forward the check to me, payable to Coppell
Apartments I, L.P.
