Dear Ken:
Per our recent conversations, we understand that three (3) items remain prior to final approval
on the referenced project by the City of Coppell. These items are as follows
1. Concrete sidewalk needs to be installed in the public area in the hammerhead
cul-de-sac between lots 31 and 34. As we discussed, we originally planned to have
the builders on lots 31 and 34 construct the intervening sidewalk in order to prevent
damage to the sidewalk during the home construction phase. We will, however,
proceed at this time with our site developmem contractor to provide this sidewalk. I
will be meeting on site with Marie Sinacola & Sons on July 24, to proceed with this
work. We would anticipate that this work would be completed no later than August
31, 1997.
2. Retaining wall needs to be installed along the alley at the outfall of the storm
sewer line. Dowdey Anderson indicates the retaining wall has been constructed along
the alley per the city comments. I have left a voice message with your field inspector,
Oarreth Campbell, to review the installation and advise on any additional work which
may be required. Upon receipt of any additional information, we will immediately
proceed with modifications.
3. Erosion control bond needs to be provided. Per our telephone conversation you
indicated the erosion control bond could either be an assurity bond, a certificate of
deposit, a letter of credit, or a cash deposit held for two years. I have advised our
client, Baptist Foundation of Texas, of these options in meeting this requirement. As I
indicated, my discussions with our typical bonding companies indicated that no
bonding company typically writes erosion control bonds. We will be forwarding
appropriate documentation meeting one of these requirements to you early next week
for this erosion control bond.

Ken, we appreciate your assistance in working with us on this project. We understand that,
based on our agreement to proceed with the above, building permits will be released in the
project. It is noted however, in the event we do not complete the above items prior to
completion of house constructions, the certificate of occupancy will not be granted until these
items arc complctc.
