Please enjoy the enclosed as a small token of my appreciation--I bet you'll find it hard to believe that my husband first introduced me to this boold! On a more serious note, although it was not mentioned at Tuesday night's Council meeting, I trust that you will make all concerned aware that as per our conversation the morning of Tuesday, 9 February and contrary to your letter of 8 February 1999, the old tree ordinance will, in fact, have jurisdiction and require the developer to preserve all trees 3' caliper and greater in all required yard areas (exclusive of filled areas), specifically in the no fill/no build easements, until such residences are owner-occupied. I did not receive assurance from the architect that anything less than 6-8" would be preserved and would instead be cleared away as "underbrush." A letter of correction for my file would also be greatly appreciated at your earliest convenience. I would also like to ask that we be especially aware of the details of the mitigation plan promised by Brentwood Builders to the Army Corps. In partio~lar, the stipulation to "decrease the depth of the lots to accommodate two green belts," I believe, has not been fully addressed. Had this been done on the plat, I think it would have eliminated many of the concerns about landowner rights being taken away by the easement. This is especially true in the easements behind Lots 7A, 15A, and 16A which, unless the mitigation plan changes, are protected wetlands under the jurisdiction of the Army Corps. I know I'm probably "sweating the small stuff," but thanks just the same for being sensitive to not only my concerns, but to all the citizens in our community. Sincerely, Tracey S.
