HISTORY: In 1994 the Planning and Zoning Commission recommended denial and
City Council denied a special use permit for a Wendy's restaurant on
property immediately adjacent to the south. The applicant threatened a
law suit. Subsequently, the City and The Parks of Coppell Trust entered
into a settlement agreement entitling the Parks of Coppell Trust to
construct and operate 2 restaurants with window service on two specific
locations in Town Center. The Wendy's site is one of the two specified
restaurant sites. One of the terms of the settlement is that no special use
permit shall be required as a condition for issuance of a building permit
or certificate of occupancy on either site. The preliminary plat was
approved by the Planning and Zoning Commission on June 15, 1995 and
by City Council on July 11, 1995.

TRANSPORTATION: Denton Tap Road is a P6D, six-lane divided thoroughfare built to
standard in a 100 foot right-of-way.

COMPREHENSIVE PLAN: The 1987 Plan showed Town Center uses.
DISCUSSION:
The proposed Wendy's restaurant reflects the city's masonry architectural tradition. The
landscape plan attempts to preserve three post oak trees and one hackberry tree ranging in
size from 10" to 17" in caliper. Cedar Elms will be the dominant street tree as required by
the streetscape plan which establishes a sense of cohesiveness throughout the City.
The proposed monument sign is cast stone on a brick pillar with a cast stone cap. The total
area of the face of the pillar is to be 60 square feet. Although we prefer a sign of 40 to 50
square feet in size, the proposed sign is acceptable. Proposed parking facilities are more
than adequate to meet the demand generated by the restaurant, and the site plan meets all of
the city's landscape requirements.
City Council has asked the copies of the architectural renderings be placed in the plat file to
show what the finished building will look like.
Recommendation:
Staff recommends approval of this final plat subject to the following conditions being met:
1. Revise signature block for P&Z Chairman, P&Z Secretary and City Secretary.
2. Show the existing 17" post oak tree on the eastern property line on the site plan.
3. Show visibility sight triangle easements at all ingress/egress points.
4. Show all utility easements.
5. Elevation(s) of finished building to be placed in plat file for reference.
