hopes that you may determine rh.t the risks and rewards arc acccptnble to thc etD' a.d approve our altered fill
plan. F~rs~ of all. I have included a rcviscd draft of ;tn casement that St. Judes is willing to sign for the boned!
of thc City of Copper Secondly; ou~ proposed fill plan docs not affect the cut~ent location of thc m~m but
ulstcad ndds o. ly 2 feet o£ fill over the ~ery rear portion of our tt-act. The fir.~r siru'.,l~on, as best as wc can
deterffmle, is that constl.ltants hn~x; recommended ~l~e possibility ,~f keeping thc existing line ~arilh some
modificarmns. If this happens, as I stated, otu: new fill plan do¢.~ not increase the elevation of fill ovc~ thc area
where thc current linc. is located.
Thc second situanon goe.~ back a couple of months when thc ciD' wa,~ willing to let us fill to rkis new plan
if thc potential ca.,tcm¢,~t by St. Judes ,ams accep!able to tl~e ci~; Tlus casement was not acceptable because it
was too restrictive. We have sh~cc let St. Jades knox,- how import.ant the correct fill plan will be to finally
res~k'ing d~e drmtage problem m the azca ,,s,-Imch affects them the most. They have rev~ewcd otu plans and
agree on the importan£'e of going with the best plan with rcspcct to drainage and have therefore revised thea~
casement. I am hop¢~l that ,~hould ,his easement be what the ciD' wa,, looking for originally; ~hal the ctty will
be able. i,~ good conscience, to oncc again go for~-ard ,~-ith ~his new fill plan. Ho~-cvcr, should this not be the
case and the city is left w~th construc~lg a new main in our casement ~hen I am told that the fill should oo*
negatively affect thc city because a pressunzed sys!em can be placed at any dcpth.
I hope tho? what I ~um being told ~s correct and I hope that you will agree th:~t the ci.-y i~ not being affected
adversely. Furthermot-c, I hope that thc knowledge that the drain,ge pzoblem is being addrcsscd in thc best
,nd mos~ agg~e.s.sive way will balance out the frustration and difficulties that the ci~- has faced. In the end thc
problcm.~ in thai area will he mitigated tremendously oz eliqm~ated and that is avcr)' positive ',ccomphshment.
Finally, I do undc~stand exactly how f:~r *he cwt' has gone to work ~th us and othcrs on one of thc mo~t
difficult engmeem~g situations my cngmccr ha~ cvcr bccv involved with. We do appreciate ~t and xt~: a~c u3mg
to arrix~ at the be,~t tesolul~on for ~he problem, the parties revolved, and thc ciD'. 'l'hank you in advance for
