Date: December 21, 1999 Re: Wrangler Drive Project Larry Davis requested that I provide you with some of my notes from our meeting on 12/08/99 to assist you in preparing the letter to TISEO Paving regarding final contrad time charged to the Wrangler Drive project, 1. The total contract time charged to the project through August 5, 1999 (the date of final walk-thru) was 422 days. a, Additional contract time could be charged, in accordance with Item 1.6 of the Special Project Requirements, for the time required to complete the City's punch list of items necessary to satisfactorily complete the project, however to-date this time has not been assessed. The punch lists were provided to TISEO on either 8/9/99 or 8/10/99. These items were not fully addressed until some time in September or October 1999, 2. TISEO has failed to provide a critical path schedule for the project which would demonstrate that the critical path was adversely impacted and that any loss of time could not have been made up by revising the sequence of work for the project in accordance to Item SC-1 °36 of the Supplementary Conditions. 3. TISEO's failure to have a competent superintendent on the project at all times as required by Item 1.14 of the Special Project Requirements (reference letters to TISEO from TNP dated 10/12/98 and from Larry Davis dated 2/5/99 & 2/9/99) contributed to the delay in locating utility conflicts and the coordination of their adjustment, 4, TISEO provided the City with written notice of concerns regarding utility conflicts in a letter dated 11/17/98, No other written notification was received by the City within the 7-day time, stipulated in Item 1.36 of the General Conditions. 5. TISEO's request for time extensions due to utility conflicts has some measure of merit, however, no time extensions can be made without a demonstration of how these conflicts adversely impacted the critical path schedule for the project. Reference Item 3(e) of the Bid Form. c, Reference Item 7.3 of the Standard Form of Agreement, d. Reference Item 1.16 of the Specific Project Requirements. 6. TISEO's request for time extension due to severe weather conditions does not appear to be justified. a. Other projects within the same time period progressed without time extensions. b. No relationship to critical path has been demonstrated (see Comment No. 2 above), c. No written request was received in accordance with Contract requirements (see Comment No, 4 above) 7. TISEO's request for time extension for Change Order No. I is not justified. No change to the contract time was made since the additional work added by that change order could be performed and completed concurrently with the remaining work on the project and, therefore, did not adversely impact the critical path for overall completion (see letter to TISEO from TNP dated 1/15/99). 8. TISEO's request for time extension due to material shortage does not appear to meet the contract requirements for time extensions, a. No relationship to critical path has been demonstrated (see Comment No. 2 above). b.
