Dear Sir:
This letter is written as a follow-up to Cristin Hall's letter of January 10, 1997 to Isabelle
Moro concerning the usage of the easements filed in Volume 85070, Page 2974 and Volume
95199, Page 05091 that transverse the referenced property. Her letter states that the
grantor is concerned about whether or not they can utilize the surface area of the
easements. The easements as dedicated are for underground utilities and as such the City
of Coppeil does allow surface encroachments over the easements with the exception of any
type of facility, building, structure, etc.
In reference to Ms. Hall's letter, the City will allow driveways, parking areas, curbs and
landscaping to encroach within these easements. The only thing that concerns me about
her letter is the "etc." at the end of landscaping. Again, the City would not allow any type
of structure to encroach into the easement.
Ms. Hall's letter indicates that she would be willing to prepare modification documents.
It is my opinion that that is not necessary. However, if it is your opinion that some type
of official modification needs to be made to the easements then Ms. Hall should prepare
those documents and process then to the City for our review prior to their being executed
and filed at the County. I will be happy to discuss this with you or Ms. Hall.
