Dear Ms. Moro:
AS we discussed yes:erday, this firm represents Ewing
Properties, Inc. and its affiliates in connection wi=h the sale
of certain property located in Coppell, Texas, a description of
which is attached hereto as ~xhibi~_.A for your reference. The
purchaser of the property has objected to the referenced
easements as neither document creating such easemen=s retains any
right of the grantor of the easement or its successors and
assigns to use the surface of the property over which the
easements were granted. We would therefore like to modify both.
easements to clarify that the grantor and its successors and
assigns have the right to the surface for uses such as driveways,
parking areas, curbs, landscaping, etc.
I have attached copies of the two easements for your
reference. Please call me as soon as you have had an opportunity
to review them. We will prepare the modification documents if
you prefer, or if you have a form, please fax me the same. We
would like to have this matter concluded as soon as possible, as
the sale will be closing later this month. I appreciate your
