Dear Mr. Priddy:
This letter is written concerning the award date for Coppell Road. The City had anticipated
awarding the project no later than the April 13, 1999 City Council meeting, however, two items
have recently surfaced which will delay the award of the project.
1)
The acquisition of the Hght-of-way from the Callejo tract. While Mr. Callejo had originally
indicated he would give a right-of-entry for the project to proceed, he has since retained an
attorney to represent him in right-of-way acquisition proceedings. At this point I am unsure
exactly what affect that will have on the timeline for award of the Coppell Road project.
An opinion from our attorney concerning the Antiquities Code of Texas. The Antiquities
Code is administered by the Texas Historical Commission and any project which has an area
larger than 5 acres has to receive a permit prior to beginning work. My calculations indicate
that slightly over six acres is associated with this project. The process for the permit requires
an archaeological evaluation of the site. I have been in contact with an archeologist to
perform the study and submit the application to the State. After the study is complete and
submitted to the commission, the commission has thirty days to respond. To date I am
unsure exac~y when the report will be submitted so it is difficult to determine when an actual
award date will take place on Coppell Road.
