Belt Line Road Coppell, TX 750198 RE: Lattimore Material, Inc. property Dear Mr. Thompson: This letter is written as a follow-up to conversations concerning the installation of a water meter to service the Lattimore Material, Inc. property. One of the City's requirements to allow new water service is not only the purchase of the meter, but also the payment of an impact fee in areas where service has previously not been provided. During our discussions, it was noted that some time in the future the City's Master Plan shows the extension of a water line along the north side of Belt Line Road from where it currently dead-ends westward to Fairway Drive. In discussions with our City Attorney, it was determined that the dedication of an easement across the Lattimore property could be provided in lieu of payment of water impact fees. Attached to this letter is a copy of a 10-foot easement across the front of the Lattimore property immediately north of and adjacent to the existing TRA easement. Once the easement has been signed and provided to the City by Lattimore Material, Inc., the City of Coppell will allow the installation of a meter to service the Lattimore Material, Inc. property without the payment of the water impact fee. Any cost associated with the purchase of the meter or any inspection of the work will still be due and payable at the appropriate times. Said casement being described in Exhibits "A" and "B" attached hereto and made a pan hereof for all purposes. That in consideration of the benefits above set out, GRANTEE will remove from the easement, such fences, buildings and other obstmctiom as may be found upon said property. After construction of the utility improvements has been completed, GRANTEE shall, except for removed obstructions, return the surface area of the easement to its original condition as nearly as practical taking into consideration the nature of the work being performed. GRANTORS reserve the right to use and maintain the surface of the easement for purposes which will not interfere with GRANTEE'S rights hereby granted and agree that upon completion of the utility improvements and restoration of the surface, GRANTEE shall not be obligated for future maintenance and upkeep of the surface area.
