Dear Mr. Doyle:
On December 22, 1987, Halff Associates obtained approval from the City of Coppell
for the construction plans prepared for the above referenced site. As the developer of the
site has failed to pay for the work, Halff Associates has withheld delivery of the approved
plans until payment is made.
The developer of the property retained a new engineer to provide a set of
construction plans for the referenced property. The new engineer prepared a revised set
of construction plans and referenced the original plans prepared by Halff Associates.
Halff Associates takes issue with the statement on the new plans which references the
original plans prepared by Halff Associates.
The Texas Engineering Practice Act, in the section entitled Professional Conduct
and Ethics, subsection 131.152-j, defines the process to be used in situations such as exist
here. The applicable section is given below.

The engineer shall submit to a client only that work (plans, specifications,
reports, etc.) done by him or under his responsible supervision; however, an
engineer, as a third party, may complete, correct, revise, or add to the work
of another engineer when engaged to do so by a client, provided:
(1)
the client furnishes the documentation of such work submitted to him
by the first engineer;
(2)
the first engineer is notified in writing by the second engiineerof the
engagement referred to in paragraph (1) of this subsection immediately
upon acceptance of the engagement; and

any work completed, corrected, revised, or added to shall have a seal
affixed by and become the respons~ility of the second engineer.
Halff Associates has not been notified in writing by the developer's current engineer
that our approved plans have been modified or are being used in any capacity.
