REQUEST: Approval to abandon only the access portion of an existing
common access and utility easement.

HISTORY: This request was initiated by the four property owners
listed, due to an encroachment of their fences within a
common access and utility easement. The City's Building
Inspection Department notified each of the owners, that the
fences situated along the rear of these properties, were in
violation of encroaching a public access easement.
Possibly, through an inadvertent error made by the fence
company, all three fences (Lots 18-20) were placed within
the easement. One of the homeowners, Mr. Hybel, in
violation of encroaching the easement, contacted the
Plannin~ Department in an effort to seek a solution which
would allow the homeowners to retain the fence in its
present location.
ANALYSIS: As indicated on the attached Exhibit "A", the present
placement of the fence along lots 18 and 19, is located
within the access and utility easement.
ITEM 8
The general purpose of the common access and utility
easement is:
To provide emergency access for utility
vehicles (due to the absence of an alley).
To allow surrounding property owners
access to the common areas.
If the Planning Commission and the City Council consider
granting approval for abandonment of the access portion of
the easement, then staff recommends that the existing
fences which encroach the easement be relocated and placed
along the rear property lines.
ALTERNATIVES: 1) Approve the request to abandon only the access portion
of easement and require fences to be relocated.
2) Deny the request.

Request for Abandonment of a Common Access £asement
Dear Ms. Bowman;
The purpose of this letter is to formally request abandonment of the
common a¢cess easement that crosses our land. The area in question
is inaccessible (see highlighted enclosure) and creates a hazard
when fenced out in accordance with the existing easement.
This common access easement does not serve a legitimate purpose
as it does not allow for common access (refer to Intghlighted
enclosure) and creates a hazard due to inaccessibility for the
purpose of proper maintenance.
This reque$! relates solely to the abandonment of the common
access easement. The existing utility easements would remain In
full force and effect.
