Mr. Brooks is requesting this variance so that a Floodplain Development Permit can be issued in order that the final plat for Villages of Coppell Phase III-B can be filed and the development can commence. The City's consultant, Mr. Ron Morrison, P.E., has reviewed the Flood Study and has found it to be in compliance with the City of Coppell Floodplain Ordinance. Item #8 of Mr. Morrison's approval letter indicates that an additional flood study run that would contain the ultimate discharge values is still required. That additional run was submitted to Mr. Morrison and the City of Coppell on April 16, 1992. It is currently under review by Mr. Morrison. However, that additional run is not required by FEMA. The approved study submitted to FEMA has been received and the acknowledgment letter was written on April 15, 1992 stating that the report is being forwarded to the technical consultants for review. The letter from Mr. Brooks indicates that if FEMA requires any minor modifications to the State prior to approval, those changes will be made. Previously, in August of 1991, a similar request was granted for the Big Cedar addition (University Park Project). Staff has no objection to this request provided the following items are complied with: 1) Any changes requested by FEMA be complied with prior to acceptance of the project by the City. 2) That the ultimate Flood Study, as required by Item #8 of Mr. Morrison's letter, be reviewed and accepted by the City prior to final acceptance of this subdivision. 3) No building permits be issued on lots in the floodplain (Lots 16 through 41, Blk A) until FEMA has approved the Flood Study. Staff will be available to answer any questions concerning this issue. 10. CoordLnate City floodplain management programs with State, regional and neighboring community floodplain management progTams. 11. Require Floodplain. Development Permits for all new construction or development in all floodplain management areas of the City. ~ a. Assure that conditional approvals are received from F£MA before a Floodplain Development Permit is issued. Upon written acknowledgment of receipt by FEMA of the required technical data, construction may commence within a floodplain area provided the person performing such development furnishes a written agreement to assume the cost of any modifications noted by FEMA, as a result of their technical reviews, to be required for proger completion. b. Require the developer to submit an as-built technical report of floodplain development conditions as soon as work affecting the floodplain is completed. Encourage the expeditious submittal of the as-built conditions in order to obtain the fixlal letters of map revision from the FEMA. 12. Make submittals to the FEMA in compliance with the provisions of this ordinance and the provisions of 44 CFR. 13. M~tain and hold open for public inspectim~ all records ~cludiag maps, elevation certificates of eligibility, elevations and floodproof~ng, permits issued, variances, appeals, and so on, as required by or generally pertainizg to the provisions of this o~ce. 14. Review, approve or deny all applications for development permits required by adoption of th~s ordinance. 15. Make interpretations as needed to determine the exact location of the boundaries of floodplain management areas or special flood hazard &teas. 16. Our ordinance requires additional information regarding the ultimate or fully developed watershed that is not included in this report. However, it is our understanding that your review is based on existing conditions so this additional information should not impact your review. Tipton, Inc. of' Dear Mr. Griffin: This is the second review of the subject study for compliance with City of Coppell Ordinance 87390. The following Gomments from our first review are addressed below: 1. There was an increase in the ultimate condition water surface elevation in Denton Creek in the first report which is not allowed according to the city ordinance. The latest submittal addresses this problem by demonstrating no increase in ultimate conditions. /~We noted that the entries in the Denton Creek FIS "Q" -100 ~ez'°'"'~ I ~Summary Table are not correct. This appears to be a <misprint. The actual values meet ordinance requirements. · /There were also some misprints in the ultimate "Q" -100 ~ ,summary table but the model results meet ordinance Vrequirements. 2. Our earlier review requested that the floodway be located on the development map to verify that the project is outside of the floodway. This has been accomplished. 3. Our first review requested that the correct floodplain should be shown on the proposed condition maps. This has been accomplished. 4. Our first review noted that a Corps 404 permit was not Page -2- Mr. Griffin provided. This latest submittal has included a Corps 404 determination and sufficiently addressed our concerns. 5. Our initial review noted that not all of the FEMA requirements had been addressed in the initial submittal. This has been accomplished. 6. The toe of fill in the original submittal extended past the property line. This has been corrected by adding a retaining wall at the property line. 7. Our initial review noted that gabian erosion protection work is being completed as part of the project but was not included in the computer model. This has now been corrected. 8. The report provided Elm Fork Models with ultimate "Q". These models showed no increase in flood levels which meets ordinance requirements. ~mere~is & ~le~'Wi~h the~e~s e~,m~m~¥~euAi&ti~/.G~i~iua~ Before recommending final approval the report will require another model showing ultimate discharge. This ultimate discharge model is not required by FEMA. Therefore, we recommend submittal of the information contained in this report to FEMA while the additional information is being prepared. Consideration of approval of an award for RFP #54 for LAN Wiring to GTE in the amount of $88,692.00. C. Councilman Robertson moved to approve Item llC as submitted in the amount of $88,692.00 to GTE. Councilman Nelson seconded the motion. Councilman Cowman excused himself from this item due to conflict of interest. The motion carried 6-0 with Mayor Pro Tem Smothermon and Councilmen Weaver, Thomas, Morton, Robertson and Nelson voting in favor of the motion. Councilman Cowman rejoined Council after this item was voted on. Item 12: Consider approval of a Resolution to enter into an Interlocal Agreement with the State of Texas for participation in the State of Texas Purchasing Program and authorizing the Mayor to sign. Mayor Pro Tem Smothermon moved to approve Resolution 042892.1 to enter into an Interlocal Agreement with the State of Texas for participation in the State of Texas Purchasing Program and authorizing the Mayor to sign. Councilman Robertson seconded the motion; motion carried 7-0 with Mayor Pro Tem Smothermon and Councilman Weaver, Thomas, Morton, Robertson and Nelson voting in favor of the motion. Item 13: Consideration of approving a resolution supporting the creation of a regional trauma system and authorizing the Mayor to sign. Mayor Pro Tem Smothermon moved to approve Resolution 042892.2 creating a regional trauma system. Councilman Nelson seconded the motion; motion carried 7-0 with Mayor Pro Tem Smothermon and Councilman Weaver, Thomas, Morton, Cowman, Robertson and Nelson voting in favor of the motion. City Engineer Ken Griffin made the presentation to the Council and stated Staff has no objection to the request provided the following three items are complied with: 1) Any changes requested by FEMA be complied with prior to acceptance of the project by the City. 2) That the ultimate Flood Study, as required by Item #8 of Mr. Morrison's letter, be reviewed and accepted by the City prior to final acceptance of this subdivision. 3) No building permits be issued on lots in the floodplain (Lots 16 through 41, Blk A) until FEMA has approved the Flood Study.
