It is my understanding that previously you spoke with Mike Martin and Rey Gonzales. Mr. Gonzales is sending you a letter detailing the City's position on this, along with a copy of the plat. The area that you are referencing is a common area which is to be maintained by the Homeowners Association. The plat is very specific in that the City has no maintenance responsibilities for this area. In general, the City's policy on maintenance of drainage areas is that the City maintains the permanent structures i.e., the pipes, concrete channels, headwalls, etc. but typically does not maintain channel areas. If the City's policy were to change, then the City would prioritized not only your problem but other problems along creeks within the City of Coppell and compare those against our Stormwater Master Plan to generate a priority list. Those issues would then be addressed as funds became available. However, because this is a common area to be maintained by the Homeowners Associates, the City would not be in this area doing any type of drainage maintenance. You have stated that the builder and the developer informed you that because this is a floodplain area, they are not allowed to do any kind of grading that might alleviate the problem. As I stated, the outfall of the drainage system could be graded to allow for positive drainage away from the area. However, any work within the existing floodplain area would require a Floodplain Development Permit from this office. Also, a plan would need to be provided showing what work was going to be performed in the floodplain area. The City would offer no objections to the Homeowners Association trying to alleviate this problem so long as a Floodplain Development Permit is obtained and water is not diverted and the work does not create a problem on adjacent properties. Again, any type of work within the floodplain will require a Floodplain Development Permit. With this letter I am providing a copy of the Floodplain Development Permit for your information.
