DATE ~ z-_ - The Engineering Department is in the process of finalizing the plans and specifications for the construction of an approximately 175 foot box culvert between Lots 20 and 21,Block B of the Fifth Section of North Lake Woodlands (149 and 153 Meadowcreek Drive) as identified in our Storm Water Management Plan. When this property was platted, a 20-foot drainage easement was platted along the common property line. However, over time the drainage way has eroded and meandered in such a way that the current location of the 20-foot drainage easement is not conducive to the installation of the box culvert. Therefore, property owners at 149 and 153 Meadowcreek Drive have been asked to dedicate drainage easements in the alignment of the proposed box culvert. This will make the 20-foot drainage easement dedicated with the plat unnecessary. Therefore, we are abandoning the entire easement as platted and the property owners are dedicating a new easement. Both property owners have agreed to the dedication of a new drainage easement. Staff will be available to answer any questions at the Council meeting. BUDGET AMT. $ AMT. Agenda Request AN ORDINANCE OF THE CITY OF COPPELL, TEXAS 2c o ORDINANCE NO. 2001-965 11/01/01 29~0004 $17.00 Deed AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ABANDONING A 20 FOOT DRAINAGE EASEMENT, LOCATED ON LOT 20 AND LOT 21, BLOCK B OF THE FIFTH SECTION, NORTH LAKE WOODLANDS AS DESCRIBED IN EXHIBITS "A" AND "B" ATTACHED HERETO, IN FAVOR OF THE ABUTTING PROPERTY OWNERS; PROVIDING THAT SUCH ABANDONMENT SHALL BE IN EXCHANGE FOR THE DEDICATION OF A DRAINAGE EASEMENT ON LOT 20 AND LOT 21, BLOCK B OF THE FIFTH SECTION, NORTH LAKE WOODLANDS; PROVIDING THAT SUCH ABANDONMENT SHALL BE IN THE INTEREST WHICH THE CITY MAY LEGALLY AND LAWFULLY ABANDON; PROVIDING THAT SAID ORDINANCE SHALL CONSTITUTE A QUITCLAIM DEED THAT MAY BE RECORDED WITH THE COUNTY CLERK OF DALLAS COUNTY TEXAS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Coppell has determined that the location of the drainage easement on Lot 20 and Lot 21, Block B of the Fifth Section, North Lake Woodlands, an Addition to the City of Coppell, Texas and more particularly described in Exlfibits "A" and "B" attached hereto, is not in the correct alignment for the construction of drainage improvements; and WHEREAS, the abutting property owner desires that said drainage easement be abandoned and in consideration thereof has dedicated to the City of Coppell, Texas, a drainage easement in the correct location; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the City Council of the City of Coppell, Texas has determined that the drainage easement located on Lot 20 and Lot 21, Block B of the Fifth Section, North Lake Woodlands, an Addition to the City of Coppell, Texas, and more particularly described in Exhibits "A" and "B", attached hereto and made a part hereof for all purposes, is no longer needed or necessary for public purposes and should be, and is hereby, abandoned in favor of the abutting property owner. SECTION 2. That upon dedication and acceptance of the new drainage easement, receipt of which is hereby acknowledged, to the City by the abutting property owner, this abandonment ordinance shall constitute a Quitclaim Deed in favor of the abutting property owner, and a certified copy of the same may be fried in the Deed Records of Dallas County, Texas, to indicate such abandonment. SECTION 3. That the abandonment provided for herein shall extend only to the public right, title and interest which the City of Coppell, Texas, may have in and to said drainage easement, and shall be construed to extend only to such interests that the governing body of the City of Coppell, Texas, may legally and lawfully abandon.
