RE: Village at Cottonwood Creek ("Village")
Dear Jim:
Thank you for working with us toward the resolution of the Coppell Road right-of-way issue
involved with the final plat for the Village. In settlement of this issue, the City and Grand Homes
a~ree to the following: ~.~t ~
1. Grand Home~ agrees to ac, quire, or p/iy the cost of acquirin8, a five foot strip of Coppell
Road right-of-way from the Callejo/~.act_by October 15, 1997. If Grand Homes is not
able to consummate the transaction,' the City will utilize its powers of eminent domain, if
necessary, to acquire this fight-of-way, G-rand Homes will pay all of the reasonable costs
associated with the condemnation.
2. Except for Lots 8 and 10 of Block B, no certificate of occupancies will be issued until the
five foot strip is acquired. Thc City will issue certificates of occupancy for Lots 8 and 10
at the request of Grand Homes.
3. The City will accept and grant in a timely manner building permit applications for single-
family houses in the Village, All pending building permit applications will be released
immediately.
