Re: Coppell Road Right of Way
Dear Ken:
I have had further contact with W'dliam Callejo and I am encouraged that an opportunity
exists to buy additional right of way from him to achieve a fifty-five foot wide right of way
before any additional dedication as would have been called for on his side of the road. He
has received positive indication from his partners that they will accept $3.00 per square
foot for the approximately 4,272 square feet of land which we have proposed to acquire.
Unfortunately, there are still some issues which will need to be resolved to Mr. Callejo's
satisfaction before we can consumate a transaction.
The Deed on the Callejo Property actually goes to the center line of Coppell Road, but
makes reference to prescriptive right of way to the east of the fence line. No conveyance
has yet been made of this prescriptive right of way.
If the Callejo Property ultimately dedicates an additional five feet on top of the right of
way that we have required, Mr. Callejo would like an assurance from the City that there
would not be a ten foot right of way dedication imposed upon him north of the northern
boundary line of our adjourning property.
Mr. Callejo would like assurance from the City of Coppell that any reconstruction cost of
Coppell Road will not be imposed upon him or his property.
Mr. Callejo has asked for a reverter of the dedication that we would require from him if it
is not used within a specified time frame.

As these items are beyond my control and would fall into the City's hands for
determination, I would like to request a meeting between the parties to try to reach a
resolution. If these items cannot be quickly resolved, I respectfully request that our
building permits be released for the Villages at Cottonwood Section V so that we may be
allowed to meet our contractual obligations to our Purchasers and Lenders to resume sales
and production within our subdivision.
