Box 478 Coppell, Texas 75019 RE: Villages of Cottonwood Creek Section V Dear Mr. Griffin: We are continuitag in our efforts to achieve an acceptable resolution to the right-of-way: shortfall on Coppell Road. I appreciate you meeting with Pat Atkins of Tipton Engineering to discuss the matter in greater detail following our meeting. As you suspected, the existing and prescriptive right-of-way along Coppell Road is less than 60' varying from 50.1 to 52.1 + along the length of our property. I have extended a formal offer to William Callejo to buy property, along the western side of Coppell Road in order to achieve our portion of the necessary dedication the City will require. Hopefully we will be able to resolve this situation with the cooperation of Mr. Callejo. We greatly appreciate your assistance in granting releases of Lots 8C and 10C for permits prior to subdivision acceptance. We are well under way on construction of both our model home and the "Home of the Year" for HOME Magazine and the National Association of Homebuilders Convention. Thanks to your assistance, we are back on schedule to complete these homes before the September deadline. Although we have not received a letter of subdivision acceptance, it is my understanding that all construction work has been completed and maintenance bonds received to the City's satisfaction. We have six lots under contract for the construction of new homes. Four of these contracts are now complete with the architectural process and have been submitted to the building inspection department for the issuance of permits. On behalf of our customers, I would greatly appreciate it if you would release those four lots while we continue to work towards resolving the right-of-way dilemma. The four lots are: Lots 20, 22, and 23 of Block A and Lot 10 of Block B. We hope that you will grant this request so that we may proceed accordingly in obtaining building permits in order to commence construction on these homes for our customers.
