Vistas of C 1stP-ES 960808 TEMPORARY SANITARY SEWER CONSTRUCTION EASEMENT STATE OF TEXAS ~ KNOW ALL MEN BY THESE PRESENTS COUNTY OF DENTON ~ THAT DENTON COUNTY LEVEE IMPROVEMENT DISTRICT NO. 1, a political subdivision of the State of Texas ("GRANTOR"), in consideration of the sum of Ten and no/100 Dollars ($10.00) and other good and valuable consideration in hand paid by the City of Coppell, Texas, receipt of which is hereby acknowledged, does by these presents grant, bargain, sell and convey unto the City of Coppell, Texas whose address is 255 Parkway Boulevard, Coppell, Texas 75019 ("Grantee"), the free and uninterrupted use, liberty and privilege of passage in, along, upon and across the following described property owned by GRANTOR for the purpose of constructing sanitary sewer improvements across GRANTOR'S adjoining real property with the right and privilege at all times, of the GRANTEE herein, its agents, employees, workmen and representatives having ingress, egress, and regress in, along, upon and across premises described in the attached Exhibit "A" (the "Easement Tract") for the purpose of constructing, making additions to or repairing said sanitary sewer improvements or any part thereof. In the event that an alternate temporary construction easement is dedicated by a plat, which is acceptable to the City of Coppell, the City agrees, that by accepting this easement and upon approval by the City Council; to abandon all right, title and interest of the City of Coppell, Texas, in and to the easement provided herein, or any portion thereof, and to quitclaim such right, title and interest to the abutting property owner(s) in accordance with its (their) respective interest(s). After construction of the sanitary sewer has been completed, GRANTEE shall return the surface area of the Easement Tract to its original condition as nearly as practical taking into consideration the nature of the work being performed. GRANTOR reserves the right to use and maintain the surface of the Easement Tract for purposes which will not interfere with GRANTEE'S rights hereby granted and agree that upon completion of the sanitary sewer and restoration of the surface, GRANTEE shall not be obligated for future maintenance and upkeep of the Easement Tract. This temporary sanitary sewer construction easement shall expire on December 10, 1996.
