its successors and assigns, together with the right and privilege at all times to enter said
premises, or any pan thereof, for the purpose of maintaining said Facilities. Any construction,
re-construction or changing of said Facilities shall require written Grantee approval.
In the event that an alternate easement is dedicated by a plat, and alternate infrastructure
facilities are provided which are acceptable to the CITY OF COPPELL, the city agrees, that
by accepting this easement and upon approval by the City Council, to abandon all right, title,
and interest of the CITY OF COPPELL, TEXAS, in and to the easement provided herein, or
any portion thereof, and to quitclaim such right, title, and interest to the abutting properly
owner(s) in accordance with its (their) respective interest(s).

not be deemed to comtrue or limit the meaning of the language of this Easement.

THAT, JOHN ADAMS whether one or more, hereinafter called ~Grantor", for and in
consideratign of the sum of One Dollar cash to Grantor in hand paid by the CITY OF
COPPELL, the receipt of which is acknowledged, and the further consideration of the benafits
to be derived by Grantor on account of the maintenance by the CITY OF COPPELL of the
STREET EASEMENT (called "Facilities"), in and through the hereinafter described premises,
does hereby give, grant, and convey to the CITY OF COPPELL, a municipal corporation of
the State of Texas, its successors and assigns, the easement and right to construct, reconstruct
and perpetually maintain Facilities, together with all incidental improvements in, upon and across
the real property located in DALLAS COUNTY, Texas, as more particularly described in
Exhibit "A" and Exhibit "B~ which is attached hereto and incorporated herein by reference as
if fully set forth herein.

Coppell, Dallas County, Texas further being pan of a tract of land conveyed to lohn Adams by
deed recorded in Volume 76112, Page 2584 of the Deed Records of Dallas County, Texas
(DRDCT) and being more panicularly described as follows;
BEGINNING at a point on the common property line of said Adams tract and Village at
Cottonwood Creek Section VI as recorded in Volume 95036, Page 1867 (DRDCT) same point
being N 00' 18' 06" W, a distance of 20.00 feet from the point of intersection of said common
property line and the North line of Clifton Court (a 50' ROW);
