Now that the drainage channel work is almost complete, we would like to address
several issues that we would like your written response to. Several of these have
been articulated in previous discussions or correspondence.
In your letter of June 9, 2000 you state that the new 8" tree is to be irrigated
by Asbury Manor HOA. Perhaps you are not aware that both sides of the
drainage channel were irrigated by an automatic underground sprinkler
system prior to commencement of construction. It is our understanding that
the contractor has indicated that he will restore the irrigation lines and
sprinkler heads that have been torn out in the construction process. This
restoration would logically include irrigation of the newly planted tree since it
is in the area that was previously irrigated by the HOA. Larry Davis has
spoken with Mr. MacDonald and requested a schematic of the sprinkler
system that was in place. We do not I~ave one, and assume that there may
not be one available. Perhaps Ryland Homes or the irrigation contractor has
one. In our opinion, your contractor should irrigate whatever grass portion
remains of the drainage easement on either side of the channel, including the
area where the above mentioned tree is to be planted. This would include the
level triangular easement area adjacent to Mr. Seeley's residence.
There has been severe settling of the grassy area up to the black metal fence
line on the west bank of the channel. This is due to the dredging of the
channel, This area has settled several inches and is now very difficult to
maintain by the landscape firm that takes care of this area for the HOA. A
construction company employee has indicated that this grassy area is outside
of his company's responsibility and that we should contact you to get this
problem resolved. Since this settling was caused by disruption of the area by
the contractor pdor to the installation of the rock and concrete, we believe that
the contractor should restore this area to the condition it was pdor to
construction. We request that the contractor grade and re-sod this area with
'~ I~ common Bermuda turf so that it can be properly maintained by the
association's landscape contractor.

' ~'~· Heavy equipment (front-end loaders and concrete trucks) has created deep
ruts in the right of way area between Westminster Way and the sidewalk by
the bddge. Also, this same thing has occurred in the easement area on the
west side of the bridge. We assume that the contractor will fill these ruts and
sod the damaged areas so that the right of way presents an image that is

expected by the City of Coppell. Also, should any sprinkler heads be
damaged, we would expect that your contractor would repair these.
The brick wall adjacent to Coppell Road on the south side of Westminster
Way has been damaged by a piece of heavy equipment. The damaged area
is about 20 feet south of the flowerbed in the first section of the bdck wall.
We request that this damage be repaired using the existing bricks.
The rock and concrete sloped walls were completed in sections. The first
section competed on the east bank, next to the Westminster Way bridge does
not look uniform in appearance with the sections completed later. We hope
that there is something that can be done to make this section blend in better

'l~Water continues to pond on the south side of the Westminster Way bridge.
We have been told that the problem is that there is silt collected upon the
concrete floor of the bddge and that the bddge floor slopes to the south,
preventing the water from draining. Our position is that the water did not
pond on the south side of the bridge prior to the construction project, and that
it is not appropriate to consider this as an acceptable condition for the future.
We feel that it should be the City's responsibility to rectify the problem so that
there is no standing water on the south side of the bridge.
· We assume that the landscaped area along Coppell Road will be restored to
the condition it was in prior to construction including repair and replacement
of the irrigation system, resodding of grass and replacement of any damaged

Please communicate to us in writing on how these issues will be addressed by
the City of Coppell. Thanks for your help in this manner. We are looking forward
to the completion of this project and feel that the final product will be esthetically
pleasing to our neighborhood and to those who travel along Coppell Road.
