AN ORDINANCE OF THE CITY OF LEWISVILLE, TEXAS, INCREASING THE SEWER RATES, METER DEPOSITS, AND PROVIDING RATES FOR TRANSPORTING LIQUID WASTE~ PROVIDING A REPEALER~ PROVIDING FOR SEVERABILITY~ PROVIDING AN EFFECTIVE DATE~ AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LEWISVILLE, TEXAS: SECTION I. AMENDMENT That Section 2-1-2 (Water Rates) of the Lewisville City Code is hereby amended as follows: Delete the present language contained in Section 2-1-2 (as amended), and in its place insert the following: "2-1-2. Water Rates: The monthly rates or charges for services furnished by the City Water Works System shall be as follows= Meter Size Minimum Bill (including 2r000 gallons) 3/4 inch $ 11.55 I inch 16.61 1-1/2 inch .31.02 2 inch 51.88 3 inch 113.73 4' inch 199.55 6 inch 444.74 8 inch 788.00 10 inch 1,229.34 Volume charge per 1,000 gallons over minimum I .83" "2-1-2a. Wholesale Water= The initial rate for treated water, if, as, and when it is received by a wholesale customer city from the City -1- of Lewisville, shall be $1.30 per 1,000 gallons of metered usage. Additionally, the fixed demand charges shall be $&8,933.00 per mgd per year." The effective date of this section upon wholesale cus- tomers shall be as stated in the wholesale contracts· SECTION II. AMENDMENT That Section 2-1-3 of the Lewisville City Code is hereby amended as follows: Delete the present language of Sections 2-1-]a and 2-1-3b relating to sewer rates, and in their place insert the following provisions 2-1-3a through 2-1-3h. "2-1-3a. Single-Family Dwellinqs: Current customers' rates shall be based upon the average monthly water consumption for the most recent December, January and February for such dwelling and charged: Monthly Minimum Bill (2,000 gallons) $4.44 Volume Charge per 1,000 (over 2,000 gallons) 1.75 2-1-3b. Non-Sinqle-Family Dwellings: Rates shall be based upon each month's water con- sumption and charge: Monthly Minimum Bill (2,000 gallons) $4.44 volume Caarge per 1,000 (over 2,000 gallons) 1.75 2-1-3c. New Customers: All new customers or current customers changing dwell- ings shall be charged a flat fee of $14.20 per month until the December, January and February average can be establishe~ at the new dwelling. -2- 2-1-Id. Landscaping: It shall be presumed that each water meter results in waste entering the sanitary sewer system. However, upon satisfactory proof that a water meter is installed and used solely for landscaping or other purposes whereby no water from such meter enters the sanitary sewer system, the City Manager or his designee may waive sewer charges. 2-1-]e. Sewer Onl7 Customers: In instances where dwellings are not served by the City Waterworks System, the charge for services furnished by the City Sanitary Sewer Systems shall be a flat fee of $14.20 per dwellingunit. 2-1-3f. wholesale Sewers: The rate for treatment of sewage received from a whole- sale customer city and treated by the City Sanitary Sewer System shall be $0.98 per 1,000 gallons of metered usage. The effective date of this section upon whole- sale customers shall be as stated in the wholesale contracts. 2-1-3g. Industrial Surcharge: The factors per 1,000 gallons for the industrial surcharge ordinance are $.001929 per mgl of BOD and $.001929 per mgl of TSS for industrial/commercial custom- ers whose sewerage strengths exceed the maximum allow- ance of 240 mgl. 2-1-3h. Transported Liquid waste: The rate for sewage transported by vehicle from within the corporate limits of Lewisville is $15.34 fo~ the first 2,000 gallons. Points of collection are restricted to portable sanitary units and septic systems approved by the City of Lewisville. A volume charge of $1.80 per 1,000 gallons, in excess of 2,000 gallons, shall be in addition to the rate charged. The City may refuse any waste if material is non-conforming with cur- rant pretreatment standards, as adopted by the City of Eewisvllle.' SECTION III. That Section 2-2-10 of the Lewisville City Code is -3- hereby amended as follows: Delete the present language of Section 2-2-10 Deposit) and in its place insert the following provision: 2-2-10. Meter Deposit: The deposit for services furnished by the Waterworks System shall be as follows: (Meter City Meter Size DeDosit 3/4 or 5/8 inch I inch 1-1/2 inch 2 inch 3 inch 4 inch 6 inch 8 inch 10 inch Construction 2 inch Construction 3 inch 50.00 50.00 125.00 350.00 425.00 500.00 550.00 875.00 1,200.00 400.00 500.00 Said deposit shall be collected by the City prior to the City's rendering such services. In the event the above-listed deposits are insufficient to pay an average monthly bill, or if experience has proved that a customer does not pay water bills promptly, and as due, the City Manager or his designee may require the meter deposit to be in any sum deemed necessary to protect the City. Such meter deposit may be applied to the payment of any water, sewer, or gar-. bage charge overdue to the City. A~y unused portion of the deposit shall be refunded to the customer at any time service is discontinued." -4- SECTION IV. EFFECTIVE DATE This Ordinance shall be effective on all water and sewer bills issued from amd after the passage of this Ordinamce. SECTION V. SEVERABI~.ITY CLAUSE If amy section or part of amy section, paragraph or clause of this Ordinamce is declared invalid or unconstitutional for any reason such declaration shall not be held to invalidate or impair the validity, force or effect of any other section or sections, part of sections, paragraphs or clause of this Ordinance. SECTION VI. REPEALER Ail ordinances or parts of ordinamces inconsistent or in conflict herewith are hereby repealed. SECTION VII.
