On February 15. 1996, the Planning and Zoning Commission disapproved a preliminary plat and subsequently on March 21. 1996, they approved the zoning, as well as a preliminary, plat. City Council approved the zoning on May 14. 1996 and the preliminar)' plat on September 10. 1996. Ciw Council approved the final plat on January 14. 1997. TRANSPORTATION: The S.H. Bypass will be built to freeway standards with access roads in 450 feet of r.o.w. Single Family-7 Item e 8 COMPREHENSB/'E PLAN: The Comprehensive Plan shows the property as suitable tbr medium densit-,' residential uses. DISCUSSION: This homeowner is claiming no knowledge of the procedures and regulations governing fences, inadvertently built a wooden fence without a fence permit. After the fence was built, an inspector from the city gave him notice that the fence was in violation of ciD· ordinances. The only recourse the applicant has at this time is to seek from the Planning and Zoning Commission and City Council a waiver to the fence line setback as it pertains to this lot. Currently, the 6-foot high wooden fence is located on the property line along Bella Vista Drive. At its present location the fence is in violation of the plat, the ordinance governing this particular planned development, as well as the homeowners' covenants, deeds, and restrictions. The plat clearly shows a 15' building line and fence line on this specific lot. One of the conditions enumerated in the PD ordinance reads "fencing of side y.'ards adjacent to proposed streets shall have a 15' setback". Lastly'. the homeowners' deed restrictions state "no fence, wall or hedge be erected or maintained on any lot nearer to the street than the building setback lines for the front Rd side yards". In addition, to violating a number of rules and regulations, the fence at its current location obstructs the sight line at the intersection of the alley and Bella Vista Drive. From a traffic safety perspective the Engineering staff can not support maintaining the fence at this location. Planning staff has a hard time supporting this request. Street-side appearance is one of the reasons for requiring a 15' building line and fence setback on corner lots. Bella Vista Drive serves as the ento' to the entire neighborhood from the north, and Waterview Drive serves as the main east/west arterial for the subdivision. Houses face both streets. The presence of the fence at its current location encroaches on public open space, and also obstructs site lines at this intersection. The encroachment of fences into public open spaces, as well as neighbors' front yards, has been a planning concern especially in older subdivisions. In the last 2 years, staff has attempted to ensure that the designs of the nexver subdivisions adequately address fence locations. RI£COMMENDATION TO THE PLANNING AND ZONING COMMISSION' Staff is sensitive to the applicant's personal circumstances and his need to retain as much of the side and rear yards for the cultivation of medicinal herbs. However. staff is uncomfortable recommending the reduction of the fence restrictions from both a traffic safety and urban design perspective. \Ve suggest that the fence be moved back to observe the 15' Item = 8 building line and fence line. This relocation would still allow the applicant use of his yard for medicinal herbs and would certainly improve the views along this street corridor. ALTERNATIVES: 1) Recommend approval of the request. 2) Recommend disapproval of the request 3) Recommend modification of the request 4) Take under advisement for reconsideration at a later date. The fence was built to the same specification as the fences of my neighbors. After the fence was built, an inspector from the city gave me notice that the fence was not built in accordance to city ordinance. I had a conversation with the inspector (Michael Hodge), and I was informed that I need it a permit and a waiver. The permit I got dated on June 21 1999; the waiver (15-feet fence line limit) is the reason for this letter. That is, I am asking the council to approve a waiver for the fence so that the fence will remain uniform as my neighbors. The reasons I am asking for this waiver is due to the following facts: I) Every house with a fence in BellaVista Dr. has a fence with the same specifications as ~ine. If the city is going to enforce the ordinance, it will have to do so homogeneously; i.e., unequal enforcement of the law is not acceptable to me. IfI have to rebuild the fence to meet the ordinance, I will demand that every house meet the ordinance with no exceptions. (See attached picture) 2) If I have to change the fence to meet the ordinance, then the landscaping oft. he street will not be uniform; my house being the odd looking house in such street.(See attached picture) 3) To build the fence according to the ordinance, the fence will have to be built right against the west wall of my house; not a possible or desirable thing to do. In other words, it is impossible to build a fence over my house comer. (See attached lots design ) 4) It is no humanity, because my family planted some foreign medicine in my yard to save very-ill family member. Due to all of above reason I strongly request this waiver, it is good ['or community's landscaping, it is good for the city, it is good for my entire family member. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Comprehensive Zoning Ordinance and Map of the City of Coppell, Texas, duly passed by the governing body of the City of Coppell, Texas, as heretofore amended, be and the same is hereby amended to grant a change in zoning'from "HC" (Highway Commercial) and MF-2 (Multi Family-2) to "PD-SF-7" (Planned Development, Single Family-7) to allow the SS262 1 development of single-family residential uses on 62.231 acres of land, located on the east side of Denton Tap Road, south of State Highway 121 Bypass, and being more particularly described in Exhibit "A" attached hereto and made a part hereof for all purposes. SECTION 2. That the property shall be developed and used only in accordance with the Site Plans, Exhibit B and Exhibit C, Landscape Plan, Exhibit D, and Development Standards, Exhibit E, and the following special conditions for development: (A) The minimum setbacks be varied; i.e. 20, 22~, or 25 feet from the front property line, with no fewer than 25% of the total number of homes in any one of these positions; (B) Fencing of side yards adjacent to proposed streets shall have a fifteen foot (15') setback, and; (C) Fitty foot (50') setback shall be provided adjacent to State Highway 121 with a six foot (6') screening wall on top of three foot (3') high earthen berm. (D) Minimum finished floor shall be two feet above existing 100 yr. floodplain elevation or one foot (1 ') above ultimate; (E) Deletion of alleys for lots which back to open space, park land and landscape areas; (F) Block length shall exceed 1200 feet on Block P and Block M of Phase 1; (G) A deceleration lane from Vista Ridge Boulevard will be installed west of Bella Vista Drive of Phase 1,100 feet in length with a 100 foot tramition; (H) A 10'xl0' comer clip will be provided at all street intersections; (I) All rear yards will be screened from view when adjacent to roadways; (J) Lot 1, Block L, and Lot 1, Block M of Phase 1, will maintain an eight foot SS262 2 building setbr 'k from the Landscape easement; (K) Lots adjacent to State Highway 121 frontage road are restricted to one story structures; (L) A deceleration lane from Vista Ridge Boulevard will be installed west of Lyndsie Drive of Phase 2, 100 feet in length with a 100 foot transition; Lot 1, Block F of Phase 2 will maintain an eight foot (8') building setback from the Landscape easement. SECTION 3. That the Site Plans, Landscape .Plan, and Development Standards, attached hereto as Exhibits "B", "C", "D" and "E", respectively, and made a part hereof for all purposes, is hereby, approved. SECTION 4. That the above property shall be used only in the manner and for the purpose provided for by the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended, and as amended herein. SECTION 5. That all provisions of the Comprehensive Zoning Ordinance of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 6. That should any sentence, paragraph, subdivision, clause, phrase or section of this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the Comprehensive Zoning Ordinance as a whole. SS262 3 SECTION 7. An offense committed before the effective date of this ordinance is governed by prior law and the provisions of the Comprehensive Zoning Ordinance, as amended, in effect when the offense was committed and the former law is continued in effect for this purpose. SECTION 8. That any person, firm or corporation violating any of the provisions or terms of this ordinance shall be subject to the same penalty as provided for in the Comprehensive Zoning Ordinance of the City of Coppell, as heretofore amended, and upon conviction shall be punished by a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense; and each and every day such violation shall continue shall be deemed to constitute a separate offense. SECTION 9. That this ordinance shall take effect immediately from and after its passage and the publication of its caption, as the law and charter in such cases provide.
