Re: Lakes ohr~oppell Utility Acceptance - Waterside Estates No. 1 Dear Ms. Daneschmand: Albert H. Halff Associates, Inc. spoke with larry Davis concerning final acceptance of the utilities in Waterside Estates No. 1 (WE1). We obtained copies of correspondence from Triland Investment Group (TIG) to the City of Coppell indicating all fees were paid in 1985. We also obtained a copy of a letter of acceptance for the paving and utilities in WE1 from Ginn, Inc. to TIG stating the one-year maintenance bonds for the water and sanitary sewer lines had been received and would expire on July 21, 1987. Mr. Davis stated that the City was already using the waterline in WE1 and, incidentally, had repaired a portion of it last year. However, since the sanitary sewer lines have never been used, he requested Sunbelt Savings, the current owner, either provide a new one-year maintenance bond for the sewer lines or have the lines pressure tested and televised to confirm there were no leaks or obstructions. We do not believe the responsibility for proving the serviceability of the sanitary sewer lines in WE1 should be with Sunbelt Savings. Ginn, Inc., acting on behalf of the City of CoppeR, accepted the utilities on July 21, 1986, and TIG provided one-year maintenance bonds at that time. We believe the City should have performed the testing/video work in July of 1987 when taking over responsibility for the maintenance of these lines. Circumstances beyond Sunbelt's control have prevented lot sales until recently. However, there is a sale pending to David Weekley Homes that could be jeopardized ff they are unable to obtain building permits. We request you review this situation and obtain authorization for the City to take the necessary steps to insure serviceability of the sanitary sewer lines in Waterside Estates No. 1.
