Dear Mr. Armstrong:
As District Engineer for Coppell M.U.D. No. 1, Pierce-Lunsford has
on several occasions expressed concern to you and other Mid-Cities
employees as to the progress, performance and workmanship of crews
performing work on both of the above subject projects. Though
some progress has been made in correcting dificiencies recognized
during execution of the work, you are now well beyond the contract
time allowed for in the contract documents. The deficiencies
listed below require immediate attention by Mid-Cities and
subcontractors to get these projects to a level which is
acceptable before moving a paving contractor in to pave the
Waterside I project and areas in question on the Raintree Village
project.
Raintree Village:
]. Enclosed is a copy of moisture and soil compaction tests
performed by Maxim Engineers on two sanitary sewer lines
which have never met utilitv line backfill specification
requirements. I understand that the water table was high in
this area and perhaps moisture content was the main
contributor in these results. It is also possible that the
backfill was placed in lifts too thick to get uniform
compaction in the ditch lines. If you feel the compaction
was sufficient, you need to write a letter accepting
responsibility if any of the ditch lines in question under
go further settling causeing failure of the paved street or
subgrade above. Otherwise you must remove and recompact the
existing backfill to required densities and optimum moisture
requirements. All other ditch lines are subject to the same
criteria.

2. Your concrete curb inlet subcontractor has been slow in
qettinq started and finishinq the work. If his work does
not improve, you should ~et someone who can satisfactorily
perform the work on a timely basis, as we have discussed in
previous telephone conversations.
3. Several of the sanitary sewer manholes on site have leaks in
the sides of the manhole. The inverts need to be ~routed to
improve flow throuqh several manholes.
Waterside Estates I:
1. As you are aware, durin~ the weekend of September ]4,
some sanitarv sewer lines which were not sufficiently
backfilled prior to a heavv rain floated above the ~rade to
which they were originally placed. Mid-Cities crews removed
and replaced much of this pipe, hut a T.V. camera inspection
performed recently on these lines indicated at least two
lines had sa~s of at least 2 inches. Repairs performed to
date have been insufficient to alleviate the problem.
Because two out of the three lines inspected had problems,
it mav be necessary to ~nspect additional lines. You must
coordinate repairs, T.V. inspections and density testinq of
backfills with Pierce-Lunsford, Ginn, Inc. add Maxim
Enqineers so that ~ualitv control can be assured to parties
responsible for acceptance of the work.
2. The overall site needs to be cleaned up and reqraded before
a Davinq contractor is allowed to move on the project.
Water is pondin~ in the intersection of Lakeshore and
Westwind Drives and needs to be eliminated bv reqradinq
areas where utilities were placed and mov~n~ your curb inlet
subcontractor on site to minimize pondJn~. Several ditch
lines have settled on site and require additional
backfillinq and recompactin~. Any ditch lines which still
do not meet soil compaction and moisture content
requirements will need to be excavated and recompacted.
Ag you know, %he Coppell M.U.D. Board elected to DaY almost
$50,000 more than the low bid to award the Raintree Village
contract to Mid-Cities. This was done in an effort to ~et a
better qualitv job with less problems and thereby reduce project
inspection, observation and laboratory testin~ costs. Instead
these costs have run biqber than normal for a oroject this size,
We need to reach an a~reement on the amount of these expenses to
be charqed aqainst this contract before final payment. Also,
have received no letter from you re~uestinq an extention of time
on either project as allowed in the contract documents, so
assume you realize they will be assessed at a rate of $150.0~ per
day for each project.

If immediate steps are not taken to alleviate the above listed
deficiencies and complete the work to a standard acceptable to
concerned parties, further steps outlined in the contract
documents will be taken to complete the project. To mv knowledqe,
no one has asked you to perform any operations not ~n accordance
with plans and specificat~.ons or the City of CoDPell subdivision
ordinance. As District Enqineers for the Coppell Municipal
Utility District No. ]., we strive to work with the developer,
contractor, City of Coppell officials and City Enqineer toward the
successful and timely completion of all projects. We expect Mid-
Cities to do the same.
