Re: Temn~wa~,, n~m,~ rha~nel Dear Mr. Griffin: AMRESCO Management represents the FDIC, the owner of a por- tion of the property involved with creation of the referenced drainage channel. Our property (PropID:ZMAN34) is located contiguous with and immediately south of the Waters Edge project, as shown on plans for the proposed drainage channel prepared by Nathan D. Maier, Consulting Engineers, and submitted to the City by the Waters Ridge Joint Venture. The Maier plans show a proposed temporary grassed swale along the north edge of our property, the purpose of which is to channel surface storm water runoff into a proposed future storm sewer line which will be installed on adjoining prop- erty owned by the Waters Edge Joint Venture. We understand that this is a temporary solution intended to serve the needs of our property until such time as the ZMAN34 tract is sold and developed by others. Please be advised that AMRESCO Management has no objection to the construction of this temporary drainage channel on the ZMAN34 tract, subject to the following conditions: 1. That a temporary drainage easement instrument is provided by the Waters Edge Joint Venture which is satisfactory to AMRESCO in both form and content. This easement will cease to exist once the permanant storm drainage line has been installed and accepted by the city. 2. That final drainage channel construction plans be accept- able to both the City and AMRESCO. 3. That all construction be the responsibility of the Waters Edge Joint Venture. 4. That the Waters Edge Joint Venture be responsible for maintaining the drainage channel after its completion and acceptance. AMRESCO Management, Inc. P.O. That the drainage channel be approved and accepted by the owners of all properties through which it passes. 6. That any costs or expenses associated with items 1-5 above be the full responsibility of the Waters Edge Joint Ven- ture.
