Box 478 Coppell, Texas 75019 214-462-0022 Mr. Tim House Matthews Southwest 5220 Spring Valley #500 Dallas, TX 75240 RE: Waters Edge Dear Mr. House: This letter is written in response to our meeting on December 2, 1992 concerning the acquisition of a offsite drainage easement on the south side of the subdivision. At that meeting, you stated that you had met with the owners of the property (FDIC) to obtain the permanent drainage easement for the installation of a headwall on their property. Your comment was that they were concerned about the installation of a permanent system and that they would much more prefer the construction of a temporary system at this time. You also stated that they were aware that the cost of the permanent system across their property would be constructed at their cost in the future. As you are aware, the City of Coppell would not release this project for construction until the acquisition of that easement along the south side of the subdivision. However, because there is now some confusion over the wishes of the owner of the property, the City of Coppell will release the subdivision for construction once a letter has been provided from yourself stating that you will provide any easements across your property and pay for the construction of the drainage system across your property at some point in the future. It was stated to you that the paving on this subdivision cannot commence until this problem has been resolved. We mutually agreed upon a date of December 23, 1992 to have a resolution to the problem. After much discussion, it was decided that the resolution would take the form of one of four options: 1) 2) 3) 4) The actual easement would be obtained for the construction of the drainage system on the south side of the property. You would purchase the property on the south side of this subdivision. A letter would be submitted from both property owners (Kroger, FDIC) that they are in concurrence with the temporary solution over the permanent solution to the drainage issue. You would have a contract in hand to purchase the property, but it would not be closed upon by the 23rd. Letter to Mr. Tim House December 3, 1992 Page 2 With this understanding and the payment of all fees and filing of the plat, etc. necessary to start the project, the City of Coppell will release this project for the start of utilities effective immediately. If your recollection of our meeting is different from the four options listed above, please respond to me in writing no later than December 9, 1992.
