RE: Metal Roofs
During a City Council meeting on January 13, 1987, members of the Council
expressed concern over the fact that metal carports had been constructed at the
Wellington Place apartments at 230 MacArthur. After review of Ordinance 296
with the City Attorney we have concluded that the carports are not in violation
of this Ordinance. The wording that has been used in this Ordinance requires that
both geographic lines be used together to create the boundary. This means that
this boundary is defined as the area west of MacArthur (Allen) Road and south
of a line 500 feet (500') north and parallel to the northern most right-of-way line
of Sandy Lake Road. The attached page illustrates the area of the city that must
comply with this Ordinance and the area that is exempt.
Also, during my discussion with the City Attorney we both stated that there is
some confusion as to whether a carport is considered a building. I bring this to
your attention so that this may be clarified in the Ordinance if changes are made
concerning the geographic boundaries.
