James Parrish Survey, A-1139 and $.A. & M.G.R.R.
Survey, A-1442, City of Coppell, Dallas County,
Texas (the "Project")
Dear Mr. Powell:
This firm represents Javatex Corporation ("Javatex") , the
owner of the 10 acre tract described above and the developer of
Wellington Place.
A problem has arisen in connection with the construction of
the Project, due to the fact, that for some reason, not apparent to
my cleint, the building inspectors for the City of Coppell are not
conducting any further inspections of the Project. It is the
understanding of Javatex that the building inspectors are following
your instructions. I have been informed that Mr. Lauw and Mr. Lynn
of Javatex and Mr. McNamara of McNamara Engineering Co. have tried
repeatedly to contact you by phone, but to no avail. In fact their
phone calls have not been returned.
Mr. Powell, we are dealing with a project for which a building
permit has been issued by the City of Coppell, and which you
"approved for construction" on February 19, 1986, by executing the
Final Plat of Wellington Place, which included a Grading & Drainage

Plan, a Water and Sanitary Sewer Plan, Sanitary Sewer Profiles, a
Drainage Area Map, a Storm Sewer Plan, Storm Sewer Profiles, Off-
Site Drainage Ditch, and a Left Turn Lane Plan. Javatex has
informed me that the Project is approximately sixty percent (60%)
completed and that numerous "green tags" have been issued by
building inspectors for the City of Coppell, including "green tags"
for the slab work, plumbing, utilities, electricity, framing, and
HVAC. Yet, without the courtesy of communicating with Javatex, the
City of Coppell has elected to discontinue building inspections of
the Project and as of this date, no communication has been furnished
to Javatex regarding a failure to comply with the plans previously
approved by you and the City of Coppell.
Mr. Powell, the construction of a project of this magnitude,
especially in the light of the present market conditions, is an
extremely demanding venture. It is important that developers and
governmental authorities cooperate to the best of their ability to
facilitate the development and construction of projects like
Wellington Place. Delays caused by not being able to obtain the
necessary building inspections or "green tags" in an expeditious
manner adds a tremendous expense to a project already stretched to
the limit.
We request that the City of Coppell be more sensitive to the
time parameters imposed upon Javatex in connection with a project
of this type. Specifically, we request that the building inspectors
be instructed to expedite the inspections of the Project requested,
and to be requested, by Javatex.
If you or the City of Coppell have any problems or concerns
regarding the Project we would appreciate an immediate written
response to this letter identifying, in detail, the problems or
concerns together with a detailed explanation of the desires of the
City of Coppell to alleviate the problems or concerns. We would
appreciate it if you would give this matter the attention it deserves.
