DECLARATION OF
PRIVATE DRAINAGE EASEMENT
THIS DECLARATION OF PRIVATE DRAINAGE EASEMENT is made this ,9-
day of QD,b€% , 2017, by Dheeraj K. and Kavita Akula, ("Declarant").
Introductory Provisions:
A. Declarant owns a certain tract of land located in the City of Coppell, Dallas
County, Texas, and described as Lot 1 R, Block A of Denton Creek at Sandy
Lake Addition, an addition to the City of Coppell, Dallas County, Texas
according to the map thereof recorded in Instrument Number 201200344384,
Official Public Records of Dallas County, Texas, said tract of land conveyed
to Dheeraj K. and Kavita Akula by Warranty Deed as recorded in County
Clerk Instrument Number 20070087752', Official Public Records of Dallas
County, Texas, (the "Property')_
B. Declarant desires to grant to the Blackberry Farm Homeowners Association, VJ A--
Inc. a Private Drainage Easement upon and across the Property to allow for -
the placement of a drainage system consisting of a surface drain and
underground drainage pipe for conveying storm water.
C. NOW, THEREFORE, Declarant hereby grants a Private Drainage Easement ‘ze
to the Blackberry Farm Homeowners Association, Inc. and declares that the
Property shall be held, sold, used and conveyed subject to the following
Private Drainage Easement and Covenants, which shall run with the title to
the Property:
1. The Property is hereby made subject to a Private Drainage Easement(the
"Easement") ten (10')wide along part of the northwest and north boundary
lines of the Property, as more particularly described in Exhibit A attached
hereto.
2. The Easement shall be for the purposes of placement of a drainage
system consisting of a surface drain and underground drainage pipe for
conveying storm water and to keep, maintain, repair and replace any
improvements so constructed.
3. This Declaration shall be binding upon all parties having any right, title or
interest in any portion of the Property, their heirs, successors, and
assigns, and shall inure to the benefit of the Declarant of the Property.
