Central Expressway Suite 333 Dallas, Texas 75231 Dear Mr. Lauw: We have reviewed the drainage plans for the Wellington Place Addition prepared by McNamara Engineering Co. dated December 6, 1985. These plans call for runoff from the site to be discharged at its northeast corner into a ditch which will take water north along the westerly line of Riverchase into the existing ditch which runs along the south side of Sandy Lake Road. We agree to execute a drainage easement in favor of the City of Coppell 15' wide in the east-west direction for the construction of the 42" storm sewer pipe shown as line "A" on sheet C5, and also agree to allow the construction of the drainage ditch shown on sheet C7 with the following conditions: 1. Line "A" should be oriented due north and fitted with a headwall. 2. The material excavated from the proposed ditch will be compacted in accordance with the grading plan for Riverchase or as directed by our engineer. Both the proposed ditch site and the proposed fill site will be stripped of vegetation to a depth of 6" prior to any filling. Fill will be compacted in loose lifts of 8" or less to a density of at least 95% Standard Proctor Density at a moisture content of between optimum and 5% above optimum. Mike Daniel at Terra is to be contacted 72 hours prior to the start of this activity. 3. Seventy-five feet of 60" storm sewer pipe with a flap gate at the end should be installed in place of the proposed ditch at its downstream end connecting to the ditch along Sandy Lake Road. A standard City of Coppell headwall should be installed at the outfall with a concrete headwall at the upstream end. We will pay the difference in cost between the 60" system and a comparable 42" system. This cost difference is to Mr. Wie Seng Lauw January 3, 1986 Page Two be determined by asking for bids with the 60" system as an alternate. The pipe should be placed 7.5' east of the west line of Riverchase. We will execute a 15-foot wide easement to accommodate the pipe. 4. The form of the easement must be acceptable to Riverchase, and should include a provision allowing Riverchase to grant other easements or privileges and make any use of the easement area it desires so long as the use does not unreasonably interfere with the rights granted by the easement. 5. You must agree to reimburse and indemnify Riverchase for any claim, damage, liability, injury to person or property, mechanics liens or other liens, and all expenses (including attorneys' fees) attributable to your activities undertaken pursuant to the easement. Further, we may require proof of insurance satisfactory to us. If you agree to these conditions, please indicate by signing in the space below.
