That is great. From the offset to the old bridge the Zayo located marked the Frontier line as his own. The conflicts from
their current marks are at all 4 bent locations. The Differences from these pictures to what we are building at a glance
are:
Picture 3 shows the south end of the bridge. His line is marked 12’ to 15’ east of the existing structure. At this
location our outside drill shaft is 1’ east of the existing wingwall.
Picture 2 shows through the middle of the creek area. The proposed bent 2 outside drill shaft at this location is
1’ east of the existing bridge rail. Bent 3 is around 10’ east of the existing bridge but their current marks show
they should be clear of us a couple of feet.
Again the photos show evidence that what they originally marked and what they are marking now are not the same

location. Their May 15 marks are the location Frontier now has their facilities marked.

We will be sending a formal response but until then some comments on the pictures:
Picture 1 – West side of bridge
Picture 2 – Frontier – We can get around this
Picture 3 – Frontier
Picture 4 – Nothing is marked down towards the creek, we found these at the marked locations
Pictures 5 and 6 – Zayo conflict, not marked until we started work on drill shafts
According to NTCOG 107.23.3 Conditions for Increases to Work or Payment, we could not determine utility locations
prior to the time of bid and these are in direct conflict with the work requiring a change in the work to be constructed.
Our notice is timely due to the fact that the utility had never previously located their facility.
In addition to this 107.23.4 Utility Coordination and Protection states “ It is the intention of the Owner that all known
conflicts between utility-owned facilities and the proposed construction will be cleared prior to the issuance of the work
order.” What we are now finding is that these were known conflicts.
