Callejo Tract Right-of-Way Acquisition
Dear Mr. Griffin:
Based on my conversations with Alan Greer and Kevin Young of Freese & Nichols, Inc., I am
forwarding the revised drawings and descriptions for the Callejo right-of-way acquisition tract.
I understand that you wish to expedite this project, so I am furnishing the City of Coppell with the
drawings and descriptions for acquiring the right-of-way from the Callejo tract by either means. The
first exhibits show the right-of-way acquisition based on the calls from the Special Warranty Deed to
William F. Callejo, Trustee dated January 7, 1980. The second exhibits show the fight-of-way
acquisition based on a court of law finding that the City of Coppell has "prescriptive rights" to the
1.124 acres stated to be in Coppelt Road by the same Special Warranty Deed.
The creation and sealing of the new right-of-way acquisition exhibit map and description does not
mean that Garcia & Associates Engineering, Inc. or Freese & Nichols is implying that the City of
Coppelt has "prescriptive fights" to the 1.124 acre tract. Only a court of law has the ability to grant
these rights. We are, however, furnishing these exhibits to assist in the timely process of acquiring
right-of-way and constructing the improvements to Coppell Road only after the judgement has been
announced.
