Box 478 Coppail, TX 75019 Dear Sirs: The Board of Directors of the Asbury Manor Homeowners Association met on Wednesday, April 26, 2000, to discuss your recommendation to remove the pecan tree adjacent to the right of way drainage channel between Coppail Road and Westminster Way. After much discussion, the board voted to allow removal of the tree under the following conditions: 1. The tree removal must inctude the entire root system in order to allow for planting of a replacement tree, 2. A replacement tree must be provided by the c'~/(minimum eight-inch caliper and a vefficel root system) and be planted within the remaining triangular shaped area. An appropriate replacement tree wouid be a live oak or other species acceptable to the Homeowners Association. We believe that these are reasonable expectations that are within the spirit of the City of Coppall Tree Presewation Ordinance number 91500-A-203. We think that a developer would be expected to preserve this tree; however, if it were to be removed an appropriate indemnification payment or replacement tree would be required. In this case the cost of the replacement tree would be more than offset by cost savings afforded to the city in not having to construct the channel around the existing pecan tree. It is our position that dty construction projects should exemplify the spirit of the Tree Preservation Ordinance. ff this offer is not acceptable, and the existing pecan tree remains, our expectation would be that no further damage to the root system be incurred and that appropriate measures towards it's preservation be taken. We understand that it is your desire to expedite this process, however, we also feel an obligation to represent the interests of the Asbury Manor HOA.
