Alexander Ct atty ltr November 12, 2007 To Whom It May Concern: REF: Apportionment of Municipal Infrastructure Costs per Texas Local Government Code Section 212.904 in Reference to Sidewalk Construction Associated with the Development of Alexander Court A request has been made for the City’s determination of the proportionality of the required sidewalk construction adjacent to Denton Tap Road in relationship to the proposed development of Alexander Court. My approach to determining the rough proportionality was to review the portions of sidewalk currently missing along Denton Tap Road and Bethel Road in the general area and then determine the number of rooftops in the general vicinity of the missing sidewalks. I then assigned a proportionate cost to each rooftop for the missing sidewalk sections. There are three subdivisions along the west side of Denton Tap Road within approximately a quarter mile of the intersection of Denton Tap and Bethel Road that currently do not have sidewalk access along Bethel or Denton Tap Road. The three subdivisions are Alexander Court, Summit at the Springs, Phases 1 and 2, and the proposed Chateaus of Coppell. The number of rooftops associated with each subdivision is: 68 in Summit at the Springs, Phases 1 and 2, a proposed 29 in Alexander Court and a proposed 56 in Chateaus of Coppell. In total there is estimated to be approximately 153 rooftops on the west side of Denton Tap Road within roughly a quarter mile of the intersection of Bethel Road and Denton Tap Road. The next item was to determine the actual amount of sidewalk currently missing adjacent to those subdivisions. I reviewed the plats, proposed plats and proposed construction plans for Bethel Road to determine the amount of sidewalk that should be constructed in the future. Along Denton Tap adjacent to Alexander Court and Chateaus of Coppell, there is approximately 1,515 feet of sidewalk that needs to be constructed. And along Bethel Road adjacent to Summit of the Springs, Phase 1 and 2 and Chateaus of Coppell there is approximately 783 feet of sidewalk that needs to be constructed. Even though Alexander Court fronts onto Bethel Road, the preliminary Bethel Road construction plans show only a sidewalk on the south side that would be adjacent to Chateaus of Coppell. Alexander Court has not been requested nor required to construct a sidewalk along the north side of Bethel Road adjacent to their southern property line. In total there is 2,298 feet of sidewalk to be constructed in the future along Denton Tap Road and Bethel Road. It should also be noted that while Alexander Court has approximately 455 feet adjacent to Denton Tap Road, there is only 320 feet of sidewalk needed because approximately 135 feet of sidewalk has already been constructed by the City of Coppell in conjunction with the Denton Tap Road bridge over Grapevine Creek. Basically, there are approximately 153 rooftops in the general vicinity along the west side of Denton Tap Road and approximately 2,298 feet of sidewalk to be constructed. Dividing the amount of sidewalk to be constructed by the number of rooftops yields a number of approximately 15 feet per rooftop that could be apportioned to the 153 rooftops. Alexander Court is proposing 29 rooftops; therefore, utilizing this approach, Alexander Court would be required to construct approximately 435 feet of sidewalk (29 x 15 = 435). Per the preliminary Bethel Road plans and the proposed Alexander Court construction plans, the city is only asking that Alexander Court build 320 feet of sidewalk adjacent to Denton Tap Road. Because the 320 feet proposed to be built by Alexander Court is less than the roughly proportionate amount of 435 feet based on the methodology above, it is my opinion as the Director of Engineering for the city of Coppell, that the 320 feet required to be constructed by Alexander Court is not excessive in regard to proportionality.
