Windsor Estates-CS000914September 14, 2000 Kelly Jordan Coppell Optimum Assets, LLC 308 Parkmeadow Way Coppell, Texas 75019 RE: Slope Agreement for Windsor Estates/Watts Property Dear Mr. Jordan: On September 14, 2000, I met with Ms. Watts concerning a proposed slope agreement. She had several concerns which include: driveway access, damage to trees, raising existing gas and water meters and adjustment of the fire hydrant. She should be in contact with you and provide you a copy of the changes made to the slope agreement. In essence, the revised agreement requires: the water meter and gas meter be raised to the new slope; the fire hydrant to be adjusted to the new slope; that driveway access be provided across the new slope; and that all work be performed south of the existing tree line and that no trees be damaged or removed in the performance of the work. Because this is an agreement between Ms. Watts and the City of Coppell, I will need a letter from you assuming all responsibilities of the City of Coppell (Grantee) in association with the slope agreement. Your letter should be very specific that you are assuming the duties to raise the water and gas meters to the new slope, to adjust the fire hydrant to the new slope, to ensure continued driveway access, and that all work will be performed south of the existing tree line. Your letter should also state that for any damage or removal of existing trees a $400.00 charge will be assessed per tree. This money will be provided to the Watts for the replacement of trees. The reference letter should be provided to the City as soon as possible. The easement will not be accepted by the City and you will not be released to perform work on Deforest Road until such time as we have this letter in our possession.
