SLOPE ~GREEMENT

COUNTY OF DALLAS ) KNOW ALL BY THESE PRESENTS:

County of Dallas, State of Texa~, for the conalderution of the sum often ($10.00) DOLLARS to the undersiBned in hand
paid by the City of Coppell (hereinafter called Grantee). the mc~eipt of which is hereby acknowledged and confessed, and
the further benefits to be derived by rernainin8 proper~y a~ a ~esult of projected improvements, has conveyed and does
hereby grant, and convey unto Grantee, it~ successor~ ~nd acknowledges an agreement for the purpose of con~'uctlng,
mainlining and using storm water dr~innge facilities in, under, over, through, across and along all that certain lot, tract or
pamel ct'land de~;ribed in Exhibit A, n~tached hereto and mad~ a pm hereof by referenc~ for nil purposes.
Grantee is acquiring this property for the purpose ofconstrucfng, malntalnin$ a slope from the surface of Deforest Road.
including the right to make the improvements on such ~'ade and according to such plans and
opinion, to best ~erve the storm w~ter drainage use. The payment for such use herein conveyed shall be considered full
compen~tlon for same ~d for any diminution in value that may result to the remaining property by virrde of project
proximity thereto, grade alignment, utility installation, or the alterslion ofdraina~e patterns.
Grantee shall have the right to maintain the grade ns n~eded to meet the intended funcfon of sald slope.
TH~ agreement rights and privileges herein gnmted shall be perpetual and shall constitute an agreement running with the
land and shall be bindin$ upon and insure to inure to the benefit of Gr~ntor and Grantee. respective heirs, successors and
assigns.
TO HAVE AND TO HOLD the above described agreement, together with nil and singular the rights and appurtenances
thereto in anywise belonging unto the said Grantee, its successors nnd n~signs forever, and Grantor is hereby bound.

Being a 1,838 square feet (0.0422 acre) slope easement situated in the W.A. Trimble Survey,
Abstract No. 1268, City of Coppell, Dallas County, and being part of a 0.930 acre tract of
land described in deed to Scott and Sharon Watts, recorded in County Clerk's Instrument
Number 96~P,0012017, of the Deed Records of Dallas County, Texas, (DR.D.C.T.), said
parcel of land also being part of Lot 1, Nettie Long Addition, recorded in Volume 96044,
Page 0233 D.R.D.C.T., said parcel of land being more particularly described by metes and
bounds as follows:
COMMENCING at a I/2-inch capped iron rod found for a comer at the southwest comer cfa
tract of land described in deed to Coppell Optimum Assets, LLC., recorded in County Clerk's
Instrument Number 97-R0067506, D.R.D.C.T.
THENCE North 00 degrees 00 minutes 00 seconds East, along the west line of said Coppell
Optimum Assets tract a distance of 30.00 feet to the POINT OF BEGINNING, said point
being the southeast corner of said Lot !, said point also being on the north right-of-way line
of Deforest Road, a 40 foot R.O.W.;
THENCE South 90 degrees 00 minutes 00 seconds West, along said right-of-way line and
along the south line of said Lot l, a distance of 293.08 feet to a found P.K. nail for a corner,
said nail being the southwest comer of said Lot 1, said nail also being the southeast corner of
