Texas 75019 972 - 462 -0022 This letter is written in response to your letter concerning Woodridge Subdivision Section 3 and the ownership of an 80 -foot drainage easement. The 80 -foot drainage easement in question is the section immediately south of Sandy Lake Road and east of MacArthur Blvd. (shown as Allen Road on the plat). The total length of the 80 -foot drainage easement is approximately 1074 feet running east of MacArthur Blvd. and adjacent to the south right -of -way line of Sandy Lake Road. The dedication language on the Woodridge Section 3 plat only dedicates to the public use the streets and alleys. The language pertaining to the drainage easement and the utility easement is that they are reserved. In essence they have been set aside for their intended use and not dedicated to the public. The intended use of the drainage easement is to convey drainage from the developments west of MacArthur Blvd. and the intended use of the utility easements is to allow a place for the franchise utility companies to install their facilities for service to the individual properties. In the same way that the property owner retains the ownership of the utility easements, the original property owner retains the ownership of the drainage easement. In this case, the original property owner was L & N Land Corp. The City does retain the right to utilize the drainage easement for the conveyance of drainage that is in the public's best interest; however, the City of Coppell does not have fee simple ownership of the 80 -foot drainage easement.
