This would be a variance of ten feet to the twenty -five foot platted front building line to allow construction of a four foot open wrought iron fence to be set fifteen feet from the right -of -way along Greenway Drive with a 10 x 10 visibility triangle at the rear property line. Commissioner Bizzell seconded the motion. Chairman Wensel, Vice-Chairman Fmka, and Commissioners Kertz and Bizzell voted to grant the variance. Commissioner Hymer voted against the variance. The variance was granted (4 for - 1 against). ITEM 6: Public Hearing to consider a request for a variance from Section 32 -3 (1) of the City's Zoning Ordinances which concerns front yard setbacks on comer lots. This variance is being requested by Mr. Danny Harris of Standard Pacific Homes, for the property located at 902 mgt Greg Jones explained that this was similar to the first variance request. The applicant is requesting a variance to erect a 4 ft. wrought iron fence 25 ft. past the 25 ft. platted front building line along Spyglass Drive. Again, the City's Zoning Ordinance requires that front yard setbacks be observed along the frontage of both intersecting streets on comer lots, as such a fence would have to be set back twenty -five feet (25') along the frontage of both intersecting streets. If unsuccessful in this appeal, the applicant is also requesting that the Board consider an alternative option of a variance of ten feet (19) to the twenty -five (25') platted front building line to allow the construction of an open wrought iron fence to be set back fifteen feet (15') from the right -of -way along Spyglass Drive. Chairman Wensel invited the applicant to come present his case. Randy Lockhart, Standard Pacific Homes, 5525 MacArthur Blvd. #580, Irving, spoke in favor of the request. He is requesting the variance on behalf of the owners at 902 Spyglass Cove. He presented the Board with a petition signed by neighbors in favor of the variance request. Chairman Wensel opened discussion to the public. Lisa Rafiki, 739 Greenway, spoke in favor of the variance request. No one else spoke either for or against the variance. This variance is being requested by Mr. Tommy Smith of Willowgate Homes, for the property located at 927 Mallard. Greg Jones gave a brief overview of the request. He stated that it was similar to the first two variance requests. The property is located in Northlake Woodlands. He passed out two more letters in opposition to the variance from neighbors of the property. In all, four written responses were received on this item The builder is requesting a variance of fifteen feet (15') r to allow the constriction of a fence that would extend fifteen feet (15') past the twenty -five foot (25') platted front building line along Pelican Lane. The City's Zoning Ordinance requires that front yard setbacks be observed along the frontage of both intersecting streets on comer lots, as such a fence would have to be set back twenty-five feet (25') along the frontage of both intersecting streets. Staffs concern is that a ten foot (10') setback seems to be an excessive variance request since the fence would be constructed of solid wood and would limit comer visibility along Pelican and Mallard. Chairman Wensel invited the applicant to come forward and present his case. Tommy Smith, Willowgate Homes, 2503 Hawthome, Carrollton, spoke in favor of the variance request. Mr. Smith stated that they needed some relief on the sideyard and would be happy with whatever the Board saw fit to grant Chairmen Wensel opened discussion to the public. Laurie Antolovic, 915 Mallard, spoke in favor of the request.
