Griffin, P.E., City Engineer ~"'""] SUBJECT: Barbara Bailey Drainage Complaint / 232 Plantation Drive DATE: July 20, 1992 As stated in my memo of July 15, 1992, I am providing updates as additional information is made available to myself concerning the drainage complaint of Barbara Bailey. On July 20, 1992, I spoke with Ms. Bailey concerning the problem. Ms. Bailey was very agitated that the problem was not already resolved as of last week and very concerned that the City was doing nothing. She was somewhat hostile during the conversation and I informed her that we were working on the problem and that we had made contact with the appropriate people. Her reply was why can't we just shut them down and not" let them nail another board up" until they have cleaned everything up. I tried to relate to Ms. Bailey that there were processes to go through. Typically, a person is given a certain amount of time to rectify a problem before the City steps in and starts levying fines and shutting down projects. Upon investigation of our Erosion Control Ordinance,it was noticed that there is a mandated 48-hour written notice to an offender before the City can step in and levy any fines or shut down any projects. After speaking to Ms. Bailey, I immediately called Waymon Levell to obtain an update on the clean up. Mr. Levell had been contacted last week and it was my understanding that the problem would start to be corrected as of last week. Apparently, there was no work done last week or over the weekend. Mr. Levell stated that he was working on getting the problem resolved and that there should be some activity taking place today. Later on in the morning I received a call from Randy Lockhart, who works with Mr. Levell. Mr. Lockhart stated that he had been to the site and that there should be some activity taking place today, i.e., the debris should be cleaned up today. To clean up the silt will take some additional time. Mr. Lockhart called back in the afternoon to provide an additional update. He stated that the builder's crew would be removing the debris today and that he was currently working on contacting a contractor to go in and hand remove the siltation from the channel. He also stated that he would be having.the alley scraped off within the next two or three days. Apparently, there has been some siltation off the graded lots into the alley and during periods of rain, the siltation from the alley washes into the drainage system and down into the channel. (cont.) Memo to Mr. Alan D. Ratliff, City Manager July 20, 1992 Page 2 He stated that if the City would bare with him, the problem would take care of itself within a month. One month is the projected time frame when the lots will be final graded and sodded. I stated that given the current status of the situation, that a month was far too long to have this problem going on and that this project needs to come into compliance with the Erosion Control Ordinance, i.e. some type of hay or silt fence should be placed on the property to retain the silt. Mr. Lockhart stated that he would pursue the installation of the silt fence to keep this problem from occurring again. I had previously informed Mr. Levell that if the problem was not in the process of being resolved by the middle of the week, that it was quite possible that the City would write a 48- hour written notice to bring the project into compliance and if it was not brought into compliance then the city might be forced to shut down the project later this week or the first of next week. I would definitely not wish to pursue that avenue. It is my opinion that this problem could be worked out in still a timely fashion between the City and the developer. The following represents the items that are set to be completed almost immediately: 1) Removal of the debris July 20, 1992 2) Scrape siltation from alley July 22, 1992 3) Installation of silt fence Week of July 20, 1992 4) Removal of siltation from the channel Week of July 27, 1992 As previously stated, this memo is written as an update to the situation.
