Dear Mr. Weber:
This letter is intended to serve as a progress report for the Coppell Road
Reconstruction project in the City of Coppell. Documented herein are several key dates
with decisions that have been previously undocumented. Also included is a current
tabulation of days used and current total of billed project charges, with explanations as
needed.
The Coppell Road Reconstruction project was begun on October 4, 1999 as per
the meeting minutes dated September 27, 1999. This date was set to be ten days after the
Notice to Proceed on September 22, 1999. The project length was bid at 240 days, which
would end the project on May 30, 2000. As of February 1, 2000, 117 project days have
been used (48.75% of project), leaving 123 days to complete the project.
Ed Bell Construction delivered a letter on October 6, 1999 requesting that time be
stopped due to water line supply problems. To date, sufficient documentation to support
the supply problem has not been delivered. Hence, time was not stopped for the days
following October 6, 1999.
Ed Bell Construction submitted a letter on October 18, 1999 requesting that time
be suspended due to legal issues regarding easements along the west side of Coppell
Road. These issues were resolved on November 2, 1999. During the time that these issues
were being resolved, sufficient work existed on the project to continue work. However, in
a spirit of fairness, the City will grant Ed Bell Construction a stoppage of project time
~'om October 18, 1999 to November 2, 1999, a total of sixteen (16) days. These days will
be added to the end of the project, thus giving a revised completion date of June 15, 2000.
With this revised completion date, Ed Bell has used approximately 46% of the project
time.
Ed Bell Construction has submitted requests to the City requesting that time not
be charged due to a lack of resolution regarding construction of the box culvert.
Specifically, Ed Bell has disputed the method of box culvert construction required by the
contract documents (maintaining two-way traffic). The City has been clear throughout the
duration of this project that closing Coppell Road for the box culvert construction would
not be an option. City Council denied a request to close the north-south portion of
Coppell Road on January 25, 2000. It is, and has been, the responsibility of Ed Bell
Construction to construct this box according to the contract. At any point in this project,
Ed Bell Construction could have and should have commenced work on the box culvert
under the terms of the contract. The City does not have control of the bidding of certain
items in the contract, or how those items will be constructed.
Ed Bell Construction asked that the City close the east-west portion of Coppell
Road, extending from the northbound SH 121 frontage road to the main entrance to The
Mansions apartments. The Coppell City Council approved closure of this portion of
Coppell Road beginning in January, 2000 and lasting approximately eight months. Staff
has made it clear that adequate advance notice is needed to inform residents and
businesses in the area of the mad closure. This portion of the paving operation needs to
be commenced at the earliest possible date.
Finally, as of January 4, 2000 Ed Bell has billed The City for a total of
$417,732.55 of project charges. The total project cost according to the contract
documents is $2,000,949.75. Charges to date represent approximately 21% of the total
contract.
