RE: Proposed Road Easement Requested by Grand Homes from FYilliam F. Callrio
Dear Mr. Jelinek:
This will acknowledge receipt of your letter dated September 16, 1997 regarding the
fight-of-way dedication requested by Grand Homes in connection with a development in the City
of Coppell, Texas.
The City has reviewed the proposed right-of-way dedication provided by facsimile
transmission dated September 16, 1997 and finds conditions 2 and 3 in their present form
unacceptable. The City Engineer advises that the seven (7) year period required for completion
of construction of the expansion of Coppell Road is not practical but rather fifteen (15) years
from the date of dedication is reasonable for the completion of construction. In addition, the City
does not want to extinguish the future obligation of the Grantor to make further dedications of
additional fight-of-way in the event of a reversion.
The City will agree to extinguish any future obligation on the part of the Grantor to make
further dedications of additional rights-of-way for the land referred to in condition 3, provid~l
such land is described by metes and bounds description and abuts Coppell Road where at least
sixty feet (60') of fight.-of-way exist as of the date of the conveyance.

We recommend that conditions 2 and 3 of the proposed fight-of-way dedication be
amended to read as follows:
Title to the land conveyed herein shall revert back to Grantor without further
action or notice on his part in the event the City does not use the land for public
road, right-of-way or other public purposes within fifteen (15) years from the date
hereof.
Provided the land has not reverted back to Grantor as provided in 2 above, the
acceptance of this deed by Grantee shall extinguish any future obligation on the
part of Grantor to make further dedications of additional fights-of-way for land
owned by Grantor abutting Coppell Road described as [insert legal description].
where at least sixty feet (60') of fight-of-way exists along Coppell Road as of the
date hereof.
Please review this matter with Mr. Callejo at your earliest convenience and advise the
undersigned as to whether such tenns are acceptable.
