Charley’s Concrete will guarantee the strength performance of the concrete mixtures submitted when placed with ambient temperatures between 40 ̊F and 100 ̊F provided plastic properties are not exceeded and concrete is placed within 90 minutes of batch time. This temperature and time range does not supersede project specifications. Changes to the mix design can be made to allow for temperature and time ranges beyond these limits. All concrete should be placed and cured in strict accordance with ACI guidelines for hot (ACI 305) and cold (ACI 306) weather concreting and may require the addition of ice during hot weather placements (at the customer’s request). During cold weather placements all concrete surfaces should be protected for a minimum of 24 hours to allow concrete to attain a compressive strength of 500 psi. ACI 304.2R “Placing Concrete by Pumping Methods” states that the inside diameter of the hose should be a minimum of 3 times the maximum aggregate size in the mixture. It is recommended to minimize or eliminate the free fall of concrete to prevent segregation and to avoid the loss of air. Boom configurations may require adjustments to the concrete mixture. Due to availability of materials, specifically natural concrete sand and fly ash, it may be necessary during the course of this project to substitute a source of material. Because of recent closures of coal fired power plants and the continued growth in the DFW market, there is a continuously decreasing supply of available fly ash for the foreseeable future, and little to no Class F fly ash available. Many concrete projects (residential, commercial, municipal, and TxDOT) are successfully utilizing ASTM Class C fly ash when it is available. While the incorporation of these admixtures will not reduce the actual concrete temperatures, the benefits of a lower water demand and increased workability are important factors in reaching higher ultimate strengths, improving the speed of placement, and reducing creep and shrinkage by counteracting the accelerating effects of higher ambient and concrete temperatures. The water-soluble chloride ion content has never been an issue and has met the requirements of ACI. We are unaware of any chloride ion content exceeding the ACI requirements resulting from the combination of local materials, specifically the combination of fine and coarse aggregates with cement, fly ash, admixtures, and water, used to batch our concrete mix designs. Thank you, Sincerely, Richard Szecsy, PhD, PE Chief Operating Officer Charley’s Concrete Limited Warranty for Ready-Mix Concrete Page 1 of 3 Original Concrete Purchaser : Project and/or Property : Concrete mixture design # : THIS LIMITED WARRANTY SUPERCEDES ALL PRIOR WARRANTY COVERAGE Charley’s Concrete Company, LTD (“Company”) hereby extends to the Purchaser of its supplied ready-mix concrete a limited warranty for the ready-mix concrete mixture design against specific performance deficiencies subject to the terms and conditions set forth below. COMPANY shall warrant that, for a period of one (1) year, beginning on the date of concrete placement at the original delivery location (“Warranty Period”), COMPANY will remedy, repair, or replace non-conforming concrete as provided in this Limited Warranty. The liability of COMPANY under this Limited Warranty shall be limited to the remedy, repair, or replacement of said non-conforming concrete as provided in this Limited Warranty and COMPANY’s total liability shall not exceed the direct expense associated with remedy, repair, or replacement of said non-conforming concrete. PLEASE READ CAREFULLY THE SCOPE AND TERMS OF YOUR LIMITED WARRANTY WARRANTY During the term of this Limited Warranty, and subject to the terms and conditions listed herein, COMPANY warrants the supplied ready-mix concrete mixture designs which COMPANY guarantees will achieve the specified compressive strength, or other performance properties of the concrete stated in the Contract Documents, as were made available at the time of quotation, when tested and evaluated in accordance with ASTM C172-99, ASTM C31/C31M-03a (including proper initial curing as per Section 10.1.2), ASTM C39/C39M-01, ASTM C94/C94M-07, or other standard test methods indicated in the Contract Documents that were necessary to verify the additional performance properties of the concrete, and when the recommended procedures for placement and curing of the in-place concrete, or those specifically outlined in ACI 305R-99 and ACI 306R-88 are followed, if and when necessary. This will also serve as a Limited Warranty that the compressive strength, or other performance properties of the concrete as specified in the original Contract Documents for the concrete supplied to the project, will meet or exceed those requirements during the one (1) year Warranty Period from when the concrete was originally supplied to the Purchaser. The Limited Warranty applies only to the original Purchaser of the supplied ready-mix concrete. LIMITATIONS This Limited Warranty and guarantee does not and will not cover any claims or liabilities related to the following items, which are expressly excluded from the coverage provided by this Limited Warranty: 1.Drying shrinkage cracking, plastic shrinkage cracking, or other cracking or cracking processes. COMPANY guarantees that concrete will crack as a normal function of the materials, due to normal processes of expansion and contraction, and because of environmental conditions that are outside of the control of COMPANY. 2.Concrete surface defects, imperfections, aesthetic blemishes or discolorations in or on the surface of the concrete. 3.Deterioration to the concrete as a result of improper, incorrect, or poor finishing practices. 4.Defects caused by normal wear and tear. 5.Materials contained within the concrete that are within allowable limits according to ASTM C33-03, ASTMC94/C94M-07, ASTM C150-07, ASTM C260-01, ASTM C494/C494M-01, ASTM C618-03, ASTM C1157-03, andASTM C1602/C1602M-06. 6.Punitive damages. 7.Incidental or consequential damages resulting from a defect covered by this Limited Warranty, including but notlimited to, loss of usage, inconvenience or damage to persons or property. Limited Warranty for Ready-Mix Concrete Page 2 of 3 8.Damage or deterioration that occurs to the concrete as a result of improper or incorrect structural design, soilinstability or movement. 9.Damage caused by weather conditions, acts of God or acts of nature, including but not limited to the following conditions: Wind storms, wind driven water, floods, hail, lightning, fallen trees, earthquakes, explosions, fire, waterescape, changes in underground water table, water seepage, land settlement, sinkholes, or site conditions. 10.Items introduced into the concrete or used on the surface of the concrete that are covered by a manufacturer’s warranty. 11.Any deficiencies or non-conformities in the ready-mix concrete mixture design not formally reported toCOMPANY within the one (1) year Warranty Period. 12.The use of salt, chlorides, or other chemicals on concrete surfaces will cause permanent damage and may result in the need to replace such surfaces. COMPANY will not be responsible for damage caused by the use of salt, chlorides, other chemicals agents, or antiskid substances on concrete surfaces. 13.Delamination on the concrete surface due to water added during finishing, hard trowel application to air-entrainedconcrete, or delayed bleed water production due to either weather conditions such as changes in temperature or relative humidity that are normal to these types of construction practices and methods. COMPANY MAKES NO OTHER WARRANTY, EXPRESSED OR IMPLIED, WRITTEN OR ORAL, OTHER THAN THOSE SET FORTH IN THIS LIMITED WARRANTY (INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR WORKMANSHIP). The placing and finishing of the supplied ready-mix concrete are not within the control of COMPANY and are, therefore, not considered manufacturing or design defects, or ready-mix concrete mixture design deficiencies. Furthermore, this Limited Warranty will not cover any conditions or issues arising as a consequence of water added to COMPANY supplied ready-mix concrete after the concrete has been brought to its required slump subsequent to transit or above the design water requirement as listed in the mixture design, which may adversely affect the concrete, and may prevent the concrete from achieving the specified compressive strength, or other performance requirements stated in the Contract Documents. Additionally, this Limited Warranty will not cover any other products added to COMPANY supplied ready-mix concrete after the concrete has arrived on site that may adversely affect the concrete, or may prevent the concrete from achieving the specified compressive strength, or other performance requirements stated in the Contract Documents. COMPANY’s PERFORMANCE In the event there are any deficiencies in the mixture design of the supplied ready-mix concrete within the one (1) year Warranty Period, the original Purchaser shall promptly give COMPANY written notice of the deficiencies, and COMPANY shall have the opportunity to inspect, remedy, replace, or repair the non-conforming concrete whose performance properties as indicated in the original Contract Documents are adversely affected by the identified and verified concrete mixture design deficiencies. Failure by the original Purchaser to give COMPANY written notice of non-conforming concrete, and/or the failure by the original Purchaser to give COMPANY the opportunity to inspect, replace, repair, or remedy the said defective material, shall constitute a waiver by the original Purchaser of any claim by the original Purchaser for the non-conforming concrete. Any repair or replacement shall not extend the warranty term. In the event non-conforming ready-mix concrete is to be remedied, repaired, or replaced pursuant to this Limited Warranty, such work will be performed by COMPANY or at its direction. Under no circumstances will COMPANY make reimbursement for remedy, repair, or replacement cost incurred by the Purchaser or any other person unless costs were approved by COMPANY in writing prior to incurrence. The original Purchaser must provide COMPANY or its designee access to the Property during normal weekday business hours to perform its obligation under this Limited Warranty. Failure to provide such access will relieve COMPANY of its obligations. Acceptance of the concrete upon arrival at the point of delivery constitutes acceptance of this Limited Warranty. Advantages High Range Water Reducing Applications: When used as a high range wa- ter reducing admixture, water reduction up to 30% can be obtained. The su-perplasticizing action allows for the production of high slump flowing concrete with excellent workability that can be placed with minimum vibration even at a low water/cement ratio. The dispersing action of Sikament 686 maximizes cement hydration efficiency and improves concrete’s early and long term com-pressive strengths. ConstructionSika® Air Air Entraining Admixture Description Sika Air admixture is an aqueous solution of organic materials. Sika Air meets the requirements of ASTM C-260 for air entraining admixtures. Applications Sika Air is recommended for use whenever air entrained concrete is desired. Ready-mix, precast and block producers can achieve predictable and uniform entrained air contents in concrete, even where harsh lean mixes are used or fly-ash is added to the concrete. Advantages Durability:  Air entrainment is recognized as the most effective prevention against con- crete scaling in exposed environments. Air entrained concrete delivers par- ticular benefits in the form of increased concrete durability. This is important in colder climates where frost and freeze-thaw cycles can cause scaling and damage to the concrete surface.  Air entraining agents help to prevent scaling by creating microscopic air voids that water trapped in the concrete can expand into when the concrete freezes, thus preventing cracks caused by the natural expansion. Entrained air voids in the concrete will also increase durability in harsh environments where concrete is exposed to deicing salts, marine salts and sulfates. Workability and Placeability:  Workability and placeability are also improved by the lubricating action of the microscopic bubbles in the concrete. Concrete will flow better, and bleeding and shrinkage will be reduced because less water is needed to obtain the desired workability. How to Use Dosage Dosage rates for Sika Air will typically fall between 0.5 and 3 fl. oz. per 100 lbs. (32 - 195 ml/100 kg) of cementitious to entrain between 4 and 6 percent air. Higher air contents may be obtained by increasing the dosage rate. Dosage rates will vary depending on the air content required for a particular project. Typically air contents will be specified in the range of 4 to 8 percent by volume. Other factors that may affect the amount of air entrained into the concrete including total cementitious content, type of pozzolanic materials, sand grada- tion, salt/clay in aggregates, temperature and water content. The use of fly ash, particularly high LOI fly ash, can result in a higher dosage of air entrain- ment.
