Re: Unauthorized use of DART railroad fight of way west of MacArthur Boulevard in Coppell
Dear Mr. Bexler:
Explorer Pipeline Company informs us, and we have field verified, that you have placed fill
material on DART-owned railroad fight of way adjacent to your development up to the toe of
slope at a depth of 6-10 feet for a distance of approximately 1/4 mile. Please be advised that this
fill must be removed immediately. No permission was given for the fill to be placed on the right
of way, and entry on the property to place this fill is considered trespassing.
Please make arrangements to remove the fill material immediately and restore the railroad
property to its original condition. We will look to you and your company for any damages that
may result/have resulted from this unauthorized entry and use.
