WITNESSETH: WHEREAS, at the southeast comer of Lot 5, Block 1, Sonic-MacAxthur Addition to the City of Coppell (the "Sonic Property") there is located a water line and tap. Pursuant to permission granted by the owners of the Sonic Property, as well as approval of the City of Coppell, Developer intends to connect an eight inch water line to such tap and to traverse the Fire Lane, Drain, and Public Access Easement at the northeast comer of Coppell Crossing (same being the southeast comer of the Sonic Property) and thereupon install an eight inch water line beneath the surface of the road constituting such fire lane. NOW, THEREFORE, for and in consideration of the grant of permission by the owners of the Sonic Property, Developer hereby burdens Coppell Crossing with the following covenants, conditions, restrictions, easements, and liens, in addition to such matters made the basis of the original declaration dated August 14, 1997. 1. Coppell Crossing shall be responsible for the repair of the area of the driveway excavated for installation of the eight inch water line. 2. Coppell Crossing shall bc responsible for any required repairs to the tap and water line caused by the connection made by Developer. 3. In the event water usage through such tap is for the benefit of Coppell Crossing. but is billed by the City of Coppell to the Sonic Property, Coppell Crossing shall be responsible to reimburse the Sonic Property for such charges. Developer hereby reserves the right to impose an assessment against the specific tract or tracts within Coppcll Crossing which required the use of water from the tap. In the event of such asse.~ment, all liens and collection procedures set forth in the original Declaration shall be applicable. 4. All other terms and conditions of the original Declaration shall remain unchanged except as necessary to facilitate the intent and purpose of this Amendment. AMENDMENT TO DECLARATION OF COVI~NANTS.
