Box 478 Coppell, Texas 75019 972-462~0022 Dear Mr. Anderson: The City of Coppell has opened bids for the reconstruction of Coppell Road. Prior to awarding the bid, necessary right-of-way and drainage easements need to be acquired. As part of the construction plans, the City will be extending a box culvert within the Common Area labeled as Lot 13A on the plat of Village of Cottonwood Creek VI. This should alleviate the standing water that currently exists in the Common Area. However, prior to constructing the box culvert the City does need to obtain a drainage easement through the Common Area. The project is on a fast track timeline and we are anticipating the construction to begin in late April. To accomplish this timeline it is imperative that the drainage easement be obtained. With this letter I am including a portion of the construction plans that shows the location of the box culverts across the existing Common Area. I am also including the drainage easement documents that show the City of Coppell is seeking to overlay the entire Lot 13A Common Area with a drainage easement. Once the box culverts are installed, the Homeowners Association will still be required to maintain the surface area as they currently do today. I apologize for (.he delay in getting this information to you. However, I did have some difficulty in obtaining the current Village of Cottonwood Creek HOA's contact name. THAT, the Village of Cottonwood Creek Section VI Homeowners Association, acting by and through the undersigned their duly authorized representative, of the County of Dallas, State of Texas, known herein as GRANTOR, in consideration of the sum of Ten and no/100 Dollars ($10.00) and other good and valuable consideration in hand paid by City of Coppell, Texas, receipt of which is hereby acknowledged, does by these presents grant, bargain, sell and convey unto City of Coppell, Texas, ("GRANTEE"), the free and tininterrupted use, liberty and privilege of passage in, along, upon and across the following described property owned by Grantor (the "easement strip") for the purpose of constructing and maintaining an underground drainage system across Grantor's main tract with the right and privilege at all times, of the GRANTEE herein, its agents, employees, workmen and representatives having ingress, egress, and regress in, along, upon and across said premises (the "easement strip") for the purpose of making additions to, improvements on and repairs to said drainage system or any part thereof. Said easement strip being described in Exhibit "A" attached hereto and made a part hereof for all purposes. That in consideration of the benefits above set out, Grantee will remove from the easement strip, such fences, buildings and other obstructions as may be found upon said property. After construction of the underground drainage system has been completed or after any entry for repairs or maintenance, GRANTEE shall, except for removed obstructions, return the surface area of the easement strip to its original condition as nearly as practical taking into consideration the nature of the work being performed. GRANTORS reserve the right to use and maintain the surface of the easement strip for purposes which will not interfere with GRANTEE'S rights hereby granted and agree that upon completion of the underground facility and restoration of the surface, GRANTEE shall not be obligated for future maintenance and upkeep of the surface area.
