Box 426 Colleyville, TX 76034 RE: Coppell Road Project ST98-01 Dear Mr. Simmons: In the near future, the City of Coppell plans to begin the reconstruction of Coppell Road. As part of the reconstruction the two driveways for the Mansions by the Lake will need to be rebuilt. Enclosed are the paving and drainage sheets for the portion of Coppell Road adjacent to the Mansions by the Lake. Sheet PV-7 shows there will be approximately a 2.5' cut on Coppell Road in front of the southern most driveway to the Mansions by the Lake. The proposed driveway sections and the limits of reconstruction are shown on Sheet CS. To rebuild the driveway the City will need to obtain a Temporary Construction Easement. This easement will permit the City's contractor to remove, re-grade and reconstruct the driveway located on your property. A note has been placed on Sheet PV-7 stating that the contractor shall match original color and type and obtain owner approval prior to replacement. Also enclosed is Sheet PV-8 which shows that the northern driveway will also need to be rebuilt. As per the paving sheet this will be accomplished within the existing right- of-way. Therefore no temporary construction easement will be needed. Please sign and notarize the Temporary Construction Easement document and return to the City in the self-addressed envelope. THAT, WESTERN RIM INVESTORS, known herein as GRANTOR, in consideration of the sum of Ten and no/100 Dollars ($10.00) and other good and valuable consideration in hand paid by City of Coppert, Texas, receipt of which is hereby acknowledged, does by these presents grant, bargain, sell and convey unto City of Coppe!l, Texas, ("GRANTEE"), the free and uninterrupted use, liberty and privilege of passage in, along, upon and across the following described property owned by Grantor (the "temporary easement strip") for the purpose of removing, regrading and reconstructing the southern most driveway to the Mansions By the Lake across Grantor's main tract with the right and privilege during the construction period, of the GRANTEE herein, its agents, employees, workmen and representatives having ingress, egress, and regress in, along, upon and across said premises (the "temporary easement strip") for the purpose of reconstructing said driveway or any part thereof. Said temporary easement strip being described in Exhibits "A" attached hereto; and made a part hereof for all purposes. That in consideration of the benefits above set out, Grantee will remove from the temporary easement strip, such fences, buildings and other obstructions as may be found upon said property. After the reconstruction of the driveway has been completed, GRANTEE shall return the surface area of the temporary easement strip to its original condition as nearly as practical taking into consideration the nature of the work being performed and the temporary construction easement shall terminate and GRANTEE shall not be obligated for future maintenance and upkeep of the surface area.
