First, such request does not recognize that each of the easements granted to TXU and Lone Star Pipeline specifically reserve to thc grantor of said easement (and grantor's assigns-being Coppeli Crossing) the right to use and enjoy the property constRuting said easement and to consmmt roads. utilities, and other facilities upon thc property constituting thc casement. Second, such rexlU~St do~s not recogniz~ that, ~x~pt for a small section ora parking lot On Lot 4, Coppell Crossing will not construct any improvements whatsoever within the boundaries of the above-referenced easements. Therefor, it is my opinion that Mr. Martin's r~quest, though made with the intent to p~ the public from aay utility interference, is an over-reach by the CRy of C. oppeU and is not neces~-y in order to obtain conslzuction permits.
